This is the second petition that has been filed under Section 439
of the Code of Criminal Procedure for grant of regular bail to the petitioner
in case FIR No. 406 dated 26.12.2017, under Section 377 IPC and Sections
3 4 of the POCSO Act (added later on), registered at Police Station
Dakha, District Ludhiana. The first petition bearing CRM-M-14343-2018
was dismissed as withdrawn on 29.05.2018.
There is no representation on behalf of the petitioner.
Learned State counsel, on instructions from ASI Gurdeep
Singh, submits that recording of prosecution evidence has been concluded
and the case is no fixed for recording the evidence of defence witnesses.
Considering the serious allegations against the petitioner, I do
not find any ground to grant regular bail to him. Even otherwise, the trial is
also at the fag end.
Therefore, this petition stands dismissed.
