This Criminal petition is filed under Section 438 of
Cr.P.C praying to enlarge the petitioners on bail in the
event of their arrest in Cr.No.9/2017 of Akkur Police
Station, Ramanagara District for the offences P/U/S
143, 324, 326, 341, 307, 425, 448, 109, 120B, 498A
read with 149 of IPC.

This petition coming on for orders, this day, the
court made the following:-

ORDER

The petitioners apprehend their arrest by the

respondent-police in their Crime No.9/2017 in respect

of the offences punishable under Sections 109, 120B,

143, 324, 326, 341, 351, 307, 425, 448 R/w Section

149 of IPC.

2. FIR is registered on the reference of a private

complaint by the Jurisdictional Magistrate. The alleged

incident is said to have been occurred on 30.04.2016.

The gist of the allegation is, the complainant and the

accused persons are relatives and they have issues over

immovable property. Petitioner No.2/Accused No.2

went near the house of the complainant No.2 and

abused him and charged his chopper at him and

complainant No.2 suffered bleeding injury and accused

No.3 dropped a size stone on him etc. As per the case

diary, the victim suffered simple injury. The alleged

weapons used for commission of offence is already

seized from the spot.

3. Having regard to the facts and

circumstances of the case, the petition is allowed. The

petitioners are enlarged on bail in crime No.9/2017 of

respondent-police subject to following conditions:

(i) They shall forthwith appear
before the respondent –
Investigating Officer. In that
event, the Investigating Officer is
at liberty to interrogate them and
investigate the matter.

(ii) In the event of their arrest, they
shall be released on bail on
executing a self bond for a sum of
Rs.50,000/- each with one surety
for the likesum to the satisfaction
of the concerned court.

(iii) They shall not threaten or
terrorise the complainant and her
family members.
