Heard learned counsel for the petitioners as well as
learned Public Prosecutor and also perused the material on record.
The petitioners have been arrested in connection with
FIR No.57/2018 of Police Station Gida, District Barmer for the
offences punishable under Sections 498A and 304_B IPC. They
have preferred this bail application under Section 439 Cr.P.C.
seeking temporary bail for a period of 30 days.
Learned counsel for the petitioners has submitted that
Megha Ram, father of petitioner No.1 and husband of respondent
No.2 has expired. It is also submitted that petitioner No.1 being
elder son in the family, his presence is must for a period of thirty

days and the petitioner No.2 is the wife of Megha Ram, her
presence is also must in the family during mourning period.
Learned Public Prosecutor has opposed the application
seeking temporary bail.
Having regard to the totality of the facts and
circumstances of the case, without expressing any opinion on the
merits of the case, I deem it just and proper to grant temporary
bail to the accused petitioners for a period of twenty days under
Section 439 CrPC
Accordingly, this bail application filed under Sec.439
CrPC is partly allowed and it is directed that petitioners Heera Lal
@ Heera Ram son of Megha Ram and Smt. Lachhi wife of Megha
Ram shall be released on bail for a period of twenty days in
connection with FIR No.57/2018 of Police Station, Gida, District
Barmer provided each of them executes a personal bond in a sum
of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/-
each to the satisfaction of learned trial court for his/her surrender
to concerned Jail after completion of twenty days from their actual
release on bail.
