Versus
State of Rajasthan Through P.P.

For Petitioner(s) : Shri Ashindra Gautam
For State : Shri A.D. Khan, P.P.
For Complainant : Shri T.R. Meena
HON’BLE MRS. JUSTICE SABINA
Order
3.10.2017

Petitioner has filed this petition under Section 438 Code of

Criminal Procedure, 1973 seeking anticipatory bail in F.I.R. No.

68/2017 registered at Police Station Mahila Police Station, District

Sawai Madhopur, for offence under Section 354 Indian Penal Code

1860, Section 66-A, 66-C, 66-D, 67(B)(D) Information

Technology Act 2000 and Section 11, 12 Protection of Children

from Sexual Offences Act, 2012.

Heard.

As per the prosecution story petitioner had downloaded

photographs of the prosecutrix from WhatsApp and Facebook

account and after editing the same had uploaded the same on

other sites with a view to defame her. It is further the case of the

prosecution that the petitioner had created a fake Facebook

Account in the name of the prosecutrix and had sent obscene

message and obscene photographs from the said account.

Petitioner had threatened the father of the prosecutrix that he
would defame the character of the prosecutrix by uploading the

pictures on porn sites.

Keeping in view the seriousness of allegations levelled

against the petitioner, no ground for grant of anticipatory bail to

him is made out. Petitioner might be required for custodial

interrogation.

Dismissed.
