This criminal petition is filed under Section 439 of
Cr.P.C., praying to enlarge the petitioner on bail in
Cr.No.70/2018 (C.C.No.947/2018) of Women Police
Station, Davanagere for the offences punishable under
Sections 498A, Section304B, Section302, Section306 r/w 34 of SectionIPC etc.

This petition coming on for orders this day, the Court
made the following;

ORDER

Women police, Davanagere have charge sheeted the

petitioner, his mother and brothers in Crime No.70/2018

for the offences punishable under Sections. 498A, 304B,

302, 306 read with Section 34 of IPC .

2. The marriage of the petitioner with Afrith Banu

was solemnized on 16/06/2016. On 16/05/2018 she

committed suicide in the house of the accused by hanging

herself. It is alleged that the petitioner and other accused

subjected the victim to physical and mental cruelty in

connection with their demand for dowry and caused her

death.

3. Petitioner was arrested on 17/05/2018 and he is

in judicial custody. As per the post-mortem report, there

were no external injuries on the dead body of the victim.

Post-mortem report and other records disclose that the

death is suicidal one.

4. The Sessions Court has granted anticipatory bail

to the co-accused who are facing the similar allegations.

The investigation is already completed. Except for trial, the

detention of the petitioner is not required for any other

purpose. Under the circumstances, the petition is allowed.

5. The petitioner is granted bail in Crime No.70/2018

which is now pending in C.C.No.947/2018 on the file of

the III Additional J.M.F.C, Davanagere, subject to the

following conditions:

1) Petitioner shall execute personal bond in a
sum of Rs.25,000/- and furnish two sureties in
the likesum to the satisfaction of the trial Court.

2) He shall not tamper the prosecution
witnesses in any manner.

3) He shall appear before the Court as and when
required.
