ORDER

Seeking to punish the respondent for having wilfully disobeyed the order of this court dated 13.06.2016 made in Crl.O.P.No.11901 of 2016.

2. Today, when the matter has been taken up for hearing, Mr.C.Emalias, the learned Additional Public Prosecutor, on instructions from Ms.N.Naseema, Inspector of Police, W-35, All Women Police Station, Tambaram, who has been present in court, submitted that pursuant to the order of this court dated 13.06.2016, the Inspector of Police, has registered a case in Crime No.50 of 2016 on 26.01.2015 for alleged offences under Sections 498A and 506(i) of IPC against Anthuvan Henry Richard. He has also produced a Xerox copy of the FIR for the perusal of this court.

3. The learned Additional Public Prosecutor would, however, add that FIR has been registered apprehending contempt action against the police by the court.

4. This court, by order dated 13.06.2016, had not directed the police to mechanically registered the FIR and the direction was only to register FIR, only if any cognizable offence is made out. In any event, since FIR has now been registered, the respondent is directed to conduct a thorough investigation and during investigation, if the accused are found to be innocents, it is needless to state that the criminal prosecution as against them should be dropped.

5. In view of the above, nothing survives in this matter for further adjudication and the contempt petition is accordingly closed.
