Before this Court is an application under Section 439 Cr.P.C.

preferred on behalf of petitioner, who has been arrested in FIR

No.124/2021 of Police Station Sujangarh, District Churu for the

offence punishable under Sections 498A, 304B in alternate Section

306 IPC.

Learned counsel for the petitioner submits that no specific

act has been attributed to the petitioner; deceased committed

suicide on her own; petitioner is lady, who is in custody since

17.06.2021; she is innocent; therefore, petitioner-accused may be

enlarged on bail.

Learned counsel for the complainant and learned Public

Prosecutor have opposed to grant of bail to the petitioner. As per

their contentions, marriage took place two years before the

incident; cruelty was committed to the deceased on account of

dowry demand.

Having considered rival contentions of the learned counsel

for the parties and material available on record, in the facts and

circumstances of the case, without commenting on the merits of

the case, this Court deem it just and proper to enlarge accused-

petitioner on bail under Section 439 Cr.P.C.

Accordingly, this bail application filed under Section 439

Cr.P.C. is allowed and it is directed that petitioner Indra Devi W/o

Late Shri Nagarmal Ji shall be released on bail in connection with

FIR No.124/2021 of Police Station Sujangarh, District Churu

provided she executes personal bonds in the sum of Rs.1,00,000/-

with two sound and solvent sureties of Rs.50,000/- each to the

satisfaction of learned trial court for her appearance before that

court on each and every date of hearing and whenever called upon

to do so till the completion of the trial.
