ORAL ORDER

1. The applicant is apprehending her arrest in connection with an FIR
being C.R. No.11193013210377 of 2021 registered with Chalala Police
Station, District Amreli for the offence punishable under
Sections 306
and
114 of the Indian Penal Code, 1860 (for short “the IPC”).

2. It is the case of the prosecution in brief is that the daughter of the
first informant had committed suicide in view of the harassment meted
out to her by the accused, including the present applicant.

3. Learned advocate for the applicant has submitted that in fact there
is no offence of
Section 498A of the IPC registered against the present
applicant. He has submitted that the applicant is 60 years of age and the
grandson, who is aged 1.5 years, is with her and she is taking care of him.

4. Under the circumstances and in light of the aforesaid facts, issue
Rule returnable on 11.08.2021. Learned APP waives service of notice of
rule for the respondent-State.

5. The applicant shall not be arrested till the next date of hearing.
However, she shall fully cooperate with the investigation and shall
remain present before the concerned Investigating Officer on 28.07.2021

between 11:00 a.m. to 5:00 p.m. for getting her statement recorded. The
Investigating Officer shall record her statement and file appropriate report
