sl no. 46

In Re : An application for anticipatory bail under Sectionsection 438 of the Code
of Criminal Procedure filed on 18.7.2019 in connection with Hirapur P.S
case no. 82 of 2019 dated 2.5.2019 under Sectionsections 498A/Section304B/Section34 of the
IPC
and
Allowed In Re : Raindra Kumar Chowdhury …… petitioner

Mr. Sourav Chatterjee
Mr. A. Ghatak
Mr. A. R. Pati
…… for the petitioner
Mr. B. Panda
Mr. S. Bhakat
…… for the State

Heard the learned advocates appearing for the respective
parties.

It is submitted on behalf of the petitioner that he is a
septuagenarian father in-law of the victim housewife and has been
falsely implicated in the instant case.

Learned lawyer for the State opposes the prayer for
anticipatory bail and submits that the victim housewife suffered
unnatural death within one year of marriage. Injuries were
detected on the body of the victim.

We have considered the materials on record including the
post mortem report of the victim. Body of the victim was recovered
from a well and no clear opinion as to the cause of death is
recorded in the post mortem report.

In view of the aforesaid facts and bearing in mind the old age
of the petitioner, we are inclined to grant anticipatory bail to the
petitioner.

Accordingly, we direct that in the event of arrest, the
petitioner shall be released on bail upon furnishing a bond of Rs.
10,000/- with two sureties of like amount each, to the satisfaction
2

of the Arresting Officer and also subject to the conditions as laid
down under Sectionsection 438(2) of the Code of Criminal Procedure,
1973 and shall appear before the court below and pray for regular
bail within four weeks from date.

The application being CRM 6356 of 2019 is disposed of.
