In Re : An application for anticipatory bail under Section 438 of
the Code of Criminal Procedure in connection with Park Street
P.S. Case No.115 dated 4.8.2017 under Sections 498A/406/
334/324/34 of the Indian Penal Code read with Section 3 /4 of
the Dowry Prohibition Act

And

In the matter of : Irfan Ahmed @ Guddu

It is submitted on behalf of the petitioner that he is the

husband of the victim housewife and has been falsely implicated

in the instant case.

Learned lawyer appearing for the State opposes the

prayer for anticipatory bail.

We have considered the materials on record particularly

the injury report of the victim wherein the name of the petitioner

does not transpire.

Keeping in mind the aforesaid fact and the extent of

complicity of the petitioner in the alleged crime, we are inclined

to grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest the

petitioner shall be released on bail upon furnishing bond of

Rs.5,000/-(Rupees Five Thousand only) with two sureties of like

amount to the satisfaction of the arresting officer and also

subject to the conditions as laid down under Section 438(2) of

the Code of Criminal Procedure, 1973.

The application for anticipatory bail is, accordingly,

allowed.

Urgent Photostat Certified copy of this order, if applied

for, be supplied expeditiously after complying with all necessary

legal formalities.
