The petitioner seeks anticipatory bail in connection with
Bauria P.S. Case No. 43 of 2016 dated 30/03/2016 under Sections
498A/302/34 of the Indian Penal Code.
The petition is by a brother-in-law of the victim who,
according to the petitioner, stands on the same footing as another
brother-in-law and sister-in-law, who have been granted anticipatory
bail by this court.
The State is represented and cannot demonstrate that there is
any additional material against this petitioner which is not against the
other brother-in-law and sister-in-law who have been granted
anticipatory bail. The State says that the charge-sheet has been filed.
In view of the fact that persons standing on the same footing
as the petitioner have been afforded anticipatory bail earlier, the
petitioner is also entitled to the same.
Accordingly, in the event of arrest, the petitioner is directed to
be released on bail upon furnishing a bond of Rs.10,000/- (Rupees
Ten Thousand only), with two sureties of Rs.5,000/- (Rupees Five
Thousand Only) each, one of whom must be local, to the satisfaction
