The petitioner prays for bail pending trial in FIR No. 16 dated
18.03.2016 registered under Section 406/498A IPC at Police Station
Women, District Amritsar City.
It is contended that the petitioner who is a 70 year old man has
been falsely implicated in the above said FIR due to a money dispute with
the complainant i.e. the mother of the victim in question.
Following order was passed in this case on 09.05.2017 :-
” Learned counsel for the petitioner has shown the
affidavit given by the complainant wherein she stated that the
matter stands compromised between the parties and she has no
objection if the F.I.R be quashed against the petitioner or he be
released on interim bail.
Learned State counsel seeks time to verify the affidavit.
List on 02.08.2017 to enable the learned State counsel to
verify the affidavit.
However, in the meantime, petitioner is ordered to be
released on interim bail, subject to his furnishing fresh bail
bonds to the satisfaction of Chief Judicial Magistrate/Duty
Magistrate, Ludhiana.”

Learned counsel for the State, on instructions from HC
Harinder Singh, verifies the authenticity of affidavit dated 08.05.2017
executed by the complainant. Photocopy of the said affidavit is taken on
record subject to just exceptions.
Keeping in view the facts and circumstances noted above but
without expressing any opinion on the merits of case, it is considered just
and expedient to allow this petition. Consequently, interim bail afforded to
the petitioner, pursuant to order dated 09.05.2017 is made absolute subject
to the petitioner furnishing fresh bail bonds and surety to the satisfaction of
the Chief Judicial Magistrate, Ludhiana.
