Judgments of Supreme Court of India and High Courts

Jaswinder Singh And Anr vs State Of Punjab on 16 February, 2018

IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH
Criminal Misc.No.M-49722 of 2017 (OM)
Date of Decision : 16.02.2018
Jaswinder Singh and another
…… Petitioners
Versus
State of Punjab …… Respondent
CORAM : HON’BLE MR. JUSTICE RAJ SHEKHAR ATTRI
***
Present : Mr. Gaurav Sharma, Advocate for the petitioners.

Mr. Karanbir Singh, AAG, Punjab.
***
RAJ SHEKHAR ATTRI, J. (Oral)

The petitioners have preferred the instant petition under

Section 438 Cr.P.C., for grant of pre-arrest bail in case FIR No.90 dated

21.11.2017, registered under Section 406 IPC and Section 24 of the

Immigration Act, at Police Station Sherpur, District Sangrur.

Learned State counsel, on instructions, has stated that the

petitioners have joined the investigation; nothing is to be recovered from

them; they are no more required for custodial interrogation and

compromise has been effected between the parties.

In the circumstances, without going into the merits of the case,

I do not deem it appropriate to deny the concession of anticipatory bail to

the petitioners in the present case.

Ordered accordingly.

Resultantly, the interim order dated 10.01.2018, passed by this

Court, is made absolute subject to the conditions as envisaged under

Section 438(2) Cr.P.C.

Petition stands allowed.
