HON’BLE MR.JUSTICE AUGUSTINE GEORGE MASIH

***
PRESENT Mr.Vinod S. Bhardwaj, Advocate,
for the appellant.

Mr.Pankaj Middha, Advocate,
for the respondent-wife.

M.M.S. BEDI, J. (ORAL)

Counsel for the appellant submits that he has got no
instructions from the appellant and has not been able to contact the
appellant despite best efforts.

Notice issued to the appellant by the Court has been
received back with a report that his address is not complete though address
given is the same as per the memo of parties filed before the lower Court as
well as before this Court.

We are satisfied that the appellant-husband is not
interested in the appeal as he has made no attempt either to pursue the
appeal or to contact his counsel. He has also not paid the maintenance
pendente lite as ordered by this Court vide order dated 11.8.2017.

In view of said circumstances, the appeal is dismissed for
non-prosecution.
