Judgments of Supreme Court of India and High Courts

Jitendra @ Jittu vs The State Of Madhya Pradesh on 7 March, 2018

THE HIGH COURT OF MADHYA PRADESH
Criminal Appeal No.1834/2018
Jabalpur, dated 7.3.2018
Mr. Neeraj Jain Nahar, learned counsel for the
appellant.
Mr. D. K. Paroha, learned Government Advocate for the
respondent-State.

Heard on I.A. No.3589/2018, which is an application for
suspension of sentence and grant of bail on behalf of the
appellant.

The appellant herein has been convicted for the offence
punishable under section 354 IPC and sentenced to suffer RI
for one year and a fine of Rs.500/-. He has also been
convicted under section 12 of the POCSO Act and sentenced
to suffer RI for one year and a fine of Rs.500/-, with default
stipulations.

Looking to the facts and circumstances of the case and
the period of short sentence of one year, I am inclined to
allow the I.A. No.3589/2018 and suspend the remaining part
of the sentence imposed upon the appellant Jitendra alias
Jittu and direct that he be released on bail on his furnishing
a personal bond in the sum of Rs.50,000/- (Rupees Fifty
Thousand only) with one surety in the like amount to the
satisfaction of the Trial Court.

Record of the trial court be called for and list the case
immediately thereafter for arguments on admission.

Certified copy as per rules.
