1. The present fourth bail application has been moved after the
statement of the victim Gaurav Mehra and statement of medical
jurist have been recorded.
2. Learned counsel for the petitioner submits that more than
one and a half year has lapsed and only two witnesses have been
examined and trial is likely to take time.
3. I have heard learned counsel. At this stage, it would be
inappropriate to make comments relating to the statements which
have been recorded. I find that the case registered under Section
377 IPC read with Section 3/4 POSCO Act and the victim has
supported the version of the prosecution. Statements of other
witnesses are required to be examined before any finding could be
arrived at. At this stage, I do not find it appropriate to release the
petitioner on bail taking into consideration the gravity of the

offence. However, in the interest of Justice, it would be
appropriate to direct the trial court to complete the trial within a
period of four months. If required, day to day trial may be
conducted for the said purpose.
4. This fourth bail application stands dismissed with the
aforesaid observations.
