ORDER

The petitioner seeks grant of anticipatory bail in relation to his

involvement as sole accused in the instant crime No. 2393/2019 of

Karamana Police Station which has been registered for offences punishable

under Secs. 498A and 323 of the SectionIPC. The learned Prosecutor was

requested to get instructions in the matter and today, when the matter has

been taken up for consideration, the learned Prosecutor would submit that

since the alleged incidents narrated in the FI Statement have taken place

mainly in a place near Bangalore in Karnataka State, the Station House

Officer, Karamana has transferred the instant crime to Kadugudy Police

Station, Bangalore, Karnataka State on 18/11/2019.

2. Smt. Varada Surendran, learned counsel appearing for the

petitioner would point out that the petitioner is suffering from serious

ailments of arsenic poisoning as can be seen from Annexures-A2 to A5

medical records and that this court may pass necessary protective orders in

that regard in the matter etc.

3. Taking note of the above said aspects, it is ordered that in case
Bail Appl..No.8634 OF 2019 3

the Station House Officer, Kadugudy Police Station, Bangalore, Karnataka

State re-registers the above said crime, then he should issue prior notice

under Sec. 41(A) of the SectionCr.P.C. to the petitioner by registered speed post

and then thereafter may proceed in the matter in accordance with the law.

Such Sec. 41 (A) notice shall be issued to the petitioner by registered post in

the above said address. The office of the Advocate General will forward a

copy of this order to the Station House Officer, Kadugudy Police Station,

Bangalore, Karnataka State for necessary information. The Registry will

also forward a certified copy of this order to Station House Officer,

Kadugudy Police Station, Bangalore, Karnataka State, for necessary

information and compliance, at the cost of the petitioner.

With these observations and directions, the above anticipatory bail

application stands disposed of.
