The petitioner has filed the instant second bail application

under Section 439 Cr.P.C. arising out of FIR No.156/2017,

registered at Police Station Nohar, District Hanumangarh for

offence punishable under Sections 302, 304B 498A/34 IPC.

Police after investigation has submitted charge-sheet in the matter

and presently trial is under progress in Sessions Case No.14/2017

before Additional District Sessions Judge No.1, Nohar, District

Hanumangarh (for short, ‘learned trial Court’).

Pressing this second bail application, it is submitted by

learned counsel for the petitioner that now investigation in the

matter has been completed. Learned counsel further submits that

during investigation, no concrete evidence has surfaced against

the petitioner so as to connect her with the commission of offence

and in fact the entire prosecution evidence is prima facie indicting

the husband of deceased and co-accused Kuldeep Singh for the

alleged offence. It is also submitted by learned counsel that

petitioner is in custody since 21 st of March, 2017 and therefore

considering the status of petitioner as woman, her second bail

application merits favourable consideration.

Learned Public Prosecutor has opposed the bail application of

petitioner. It is argued by learned Public Prosecutor that looking

to the seriousness of offence bail application of the petitioner is

liable to be thwarted.

I have bestowed my consideration to the arguments

advanced at the Bar and perused the materials available on


Having regard to the facts and circumstances of the case and

considering the fact that petitioner is a woman, without expressing

any opinion on merits of the case, I feel persuaded to enlarge her

on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is

allowed and it is ordered that accused-petitioner Karam Jeet Kaur

@ Krishna W/o Kulwant Singh, arrested in connection with F.I.R.

No.156/2017, Police Station Nohar, District Hanumangarh, may be

released on bail; provided she furnishes a personal bond of

Rs.50,000/- with two surety bonds of Rs.25,000/- each to the

satisfaction of learned trial Court with the stipulation to appear

before that Court on all dates of hearing and as and when called

upon to do so.
