The petitioners seek anticipatory bail in connection
with Kotulpur P.S. Case No. 32 of 2018 dated 28/03/2018
under Sections 498A/304B/302/34 of the Indian Penal Code.
The petitioners claim that though the case was filed,
inter alia, under Section 302 of the Penal Code, the charge-
sheet that has now been filed refers to Section 306 of the Code.
The petitioners claim that the husband and father-in-law of the
victim have been enlarged on bail.
The State produces the case diary.
The petitioners are the husband’s brother and
husband’s mother, respectively, of the victim.
Considering the allegations against the petitioners and
the fact that the husband has also been enlarged on bail, the
petitioners are entitled to obtain anticipatory bail.
Accordingly, in the event of arrest, the petitioners are
directed to be released on bail upon furnishing a bond of
Rs.10,000/- (Rupees Ten Thousand only) each, with two
sureties of Rs.5,000/- (Rupees Five Thousand Only) each, one
of whom must be local, to the satisfaction of the Arresting
