Judgment / Order

The present bail application has been filed under Section 439

Cr.P.C. on behalf of the petitioner, who is in custody in connection

with FIR NO.322/2017 lodged at Police Station Bilara, District

Jodhpur for the offence under Sections 498A and 304B IPC

Heard learned counsel for the petitioner and learned Public


It is submitted that the accused petitioner is father-in-law

and bail application of mother-in-law Smt. Choti @ Chotki has

already been accepted by the coordinate bench of this court on

5.12.2017 and the case of the accused petitioner is not

distinguishable from the case of smt. Choti 2 Chotki.

Learned counsel for the accused petitioner submits that the

petitioner may be enlarged on bail.

Learned Public Prosecutor does not dispute the fact that

Smt. Choti @ Chotki has been enlarged on bail and the case of the

accused petitioner is not distinguishable from the case of accused

appellant Kewal Ram.

Having regard to the facts and circumstances of the case and

upon a consideration of the arguments advanced at the bar, this

Court is of the opinion that the bail application filed by the

petitioner deserves to be accepted.

Consequently, the bail application is allowed. It is ordered

that the accused-petitioner, Kewal Ram S/o Shivram arrested in

connection with F.I.R. No.322/2017, Police Station Bilara, District

Jodhpur shall be released on bail; provided he furnishes a

personal bond of Rs.50,000/- and two surety bonds of Rs.25,000/-

each to the satisfaction of the learned trial court with the

stipulation to appear before that Court on all dates of hearing and

as and when called upon to do so.
