ORAL ORDER

1. Rule. Learned Public Prosecutor Mr.Mitesh Amin
waives service of notice of rule for respondent-
State.

2. The present application is filed by the
applicant seeking grant of transit bail in
connection with the offence registered at Case
No.143 of 2019 with Jadavpur Police Station
Kolkata, WB for the offences punishable under
Sections 498A, Section406 and Section34 of the Indian Penal
Code.

3. Heard learned advocate for the applicant. It
is submitted by the learned advocate for the
applicant that the FIR in question is filed for
the offence punishable under Sections 498A, Section406
and Section34 of the Indian Penal Code. It is submitted
that the applicant is apprehending his arrest in

connection with the aforesaid FIR and, therefore,
the applicant is inclined to file application
under Section 438 of the Code before the
competent Court situated at Kolkata. However,
till the applicant files the said application
under Section 438 of the Code before the
concerned Court, this Court may grant protection
to the applicant.

4. In view of the aforesaid submissions canvassed
by learned advocate for the applicant and looking
to the peculiar facts and circumstances of the
present case, this application is partly-allowed.
The application for transit anticipatory bail in
connection with Case No.143 of 2019 registered
with Jadavpur Police Station, Kolkata, WB is
granted for a period of four weeks from today to
enable the applicant to approach the competent
Court situated at Kolkata.

5. Rule is made absolute to the aforesaid extent.
Direct service is permitted.
