Petitioner is aggrieved by indolent investigation in the case
registered at his behest. It is also complained that the private
respondents are holding out threats to him and his witnesses.

Report is filed on behalf the State/respondent wherefrom it
appears that investigation is in progress and the accused persons
have appeared before the criminal Court. Prayer has also been
made for adding Section 354 IPC before the Court of Ld. Additional
Chief Judicial Magistrate, Rampurhat. It has also been recorded in
the report that police authorities are ready and willing to render
assistance to the petitioner in the matter. Report be kept with the
record. A copy of the report be handed over to the learned Advocate
for the petitioner in course of the day.

In view of such development, I dispose of the writ petition
directing the investigating agency to conduct the investigation in a
fair and impartial manner exploring all angles including the
concerns of the petitioner and to conclude the same at an early date.
It is open to the petitioner to appear before the criminal Court as a
victim of crime and seek necessary redress including necessary
order for protection of their lives in accordance with law. In the

event private respondents/accused persons resort to acts of violence
and/or criminal intimidation.

With the aforesaid directions, this petition is disposed of.

Since affidavits are not called for, the allegations contained in
the petition are deemed not to have been admitted by the
respondents.

Urgent Photostat certified copy of this order, if applied for, be
delivered to the learned Advocates for the parties, upon compliance
of all formalities.
