Before this Court is an application under Section 439 Cr.P.C.

preferred on behalf of petitioner Kirsan Pal Singh alias Gopi, who

has been arrested in connection with FIR No. 78/2021, Police

Station Makrana, District Nagaur for the offences punishable under

Sections 498A, 304B 120B IPC.

It is submitted by learned counsel for the petitioner that

there is no evidence available on record regarding commission of

offences under Section 498-A and 304-B IPC. It is submitted that

as per police report under Section 173 Cr.P.C. the dispute between

the parties was not on account of dowry and the deceased

committed suicide, for which, the petitioner cannot be blamed. It

is submitted that the trial may take time to complete and looking

to the evidence available on record the petitioner may be enlarged

on bail.

Learned counsel appearing for complainant, who is father of

the deceased, has no objection regarding grant of bail to the

petitioner.

Learned Public Prosecutor opposed the grant of bail to the

petitioner.

Having considered rival contentions of the learned counsel

for the parties and material available on record, without

expressing any opinion on merits of the case and in the facts and

circumstances of the case this Court deems it just and proper to

enlarge the accused-petitioner on bail under Section 439 Cr.P.C.

Accordingly, this bail application under Section 439 Cr.P.C. is

allowed and it is ordered that the petitioner Kiran Pal Singh alias

Gopi S/o Fateh Singh Ji shall be released on bail in connection with

FIR No. 78/2021, Police Station Makrana, District Nagaur, provided

he executes a personal bond in the sum of Rs. 1,00,000/- (rupees

One Lakh) with two sound solvent sureties of Rs. 50,000/-

(rupees Fifty Thousand) each to the satisfaction of learned trial

court for his appearance before that court on each every date of

hearing and whenever called upon to do so.
