Before this Court is an application under Section 439 Cr.P.C.
preferred on behalf of petitioner, who has been arrested in FIR
No.89/21 of Police Station Charbhuja, District Rajsamand for the
offences punishable under Sections 498A 304B of IPC.
Learned counsel for the petitioner submits that false
allegations under Section 498A and 304B of IPC have been
levelled against the petitioner; soon before the incident, no cruelty
was committed to the deceased; petitioner is behind bars since
08.04.21; investigation has been completed and trial may take
time to complete, therefore, petitioner-accused may be enlarged
on bail.

Learned Public Prosecutor and learned counsel for the
complainant have opposed the grant of bail application.
Having considered rival contentions of the learned counsel
for the parties and material available on record, without
commenting on the merits of the case, this Court deem it just
and proper to enlarge accused-petitioner on bail under Section
439 Cr.P.C.
Accordingly, this bail application filed under Section 439
Cr.P.C. is allowed and it is directed that petitioner Kishan Singh
S/o Sh. Daulat Singh Lal shall be released on bail in connection
with FIR No.89/21 of Police Station Charbhuja, District Rajsamand
provided he executes a personal bond in the sum of Rs.1,00,000/-
with two sound and solvent sureties of Rs.50,000/- each to the
satisfaction of learned trial court for his appearance before that
court on each and every date of hearing and whenever called upon
to do so till the completion of the trial.
