This is a second application for bail on behalf of the applicant, Krishna Kumar @ Lambri, in Case Crime No.122 of 2017, under Sections 498A, Section304B IPC and Section 3/Section4 of the Dowry Prohibition Act, Police Station Sisolar, District Hamirpur. The first bail application being Criminal Misc. Bail Application no.3918 of 2018 was rejected by me vide order dated 02.02.2018.
Learned Counsel for the applicant states that in this case all prosecution witnesses have been examined, statement under Section 313 Cr.P.C. remains to be recorded, after which the address of arguments by parties is the final step left.
The Court has perused the order rejecting the first bail application, dated 02.02.2018, as also the pleas raised in the present second bail application. There is no fresh ground or material to grant this second bail application. It is, accordingly, rejected.
Considering the aforesaid stage of the Trial, which has almost reached terminus, it is ordered that proceedings in Sessions Trial no.148 of 2017, SectionState vs. Krishna Kumar @ Lambari and others, pending before the Additional Sessions Judge, F.T.C.-I, Hamirpur, shall now proceed on a day-to-day basis, and shall be concluded within a period of one month next.
This order has been passed considering the fact that the applicant is in jail since 02.08.2017 as an under-trial.
