2 12-10-2018 Learned counsel for the petitioner is permitted to make

necessary correction in the petition in the course of the day.

Heard learned counsel for the petitioner.

The petitioner prays for bail in connection with Rampur

P.S.Case No. 02 of 2018 registered for the offences punishable

under Sections 420, 406 and 34 of the Indian Penal Code.

Allegation against the petitioner is of cheating the

informant and others by collecting total Rs.56 lakhs from each of

six candidates on the pretext of providing them job.

Submission of learned counsel for the petitioner is that

petitioner has falsely been implicated in this case and there is no

chit of paper to show that petitioner has taken money from them

and petitioner is in custody since 1.7.2018. Further submission is

that no case is made out under Section 406 IPC as amount was

given for illegal purpose.

Heard learned APP also.

Having heard both sides and in the facts and

circumstances, let the petitioner, named above, be released on bail

on furnishing bail bond of Rs.25,000/- (Rupees twenty five

thousand) with two sureties of the like amount each to the

satisfaction of the Additional Chief Judicial Magistrate-VIII,

Gaya, in connection with Rampur P.S.Case No.02 of 2018, subject

to the condition that one of the bailors shall be a local person

having sufficient immoveable properties within the jurisdiction of

court concerned.
