1. Learned counsel appearing for the petitioner submits that the
application filed by the petitioner under Section 7, 8 of the Guardian and
Wards Act, 1890 read with Section 6 of Hindu Minority and Guardianship
Act, 1956 for the custody of his child is pending consideration before the
Family Court, Raipur since 10.04.2018 that may be directed to be decided
expeditiously.

2. I have heard learned counsel for the petitioner.

3. Looking to the relief claimed in the application and taking into
consideration the decision rendered by Supreme Court in Bhuwan
Mohan Singh v. Meena and Others1, the Family Court, Raipur is
directed to conclude the trial and decide it within a period of six months
from the date of receipt of copy of this order. The petitioner would be at

liberty to move appropriate application before the said court for visiting
rights in accordance with law.

5. With the aforesaid observation, the writ petition stands disposed of.
No order as to cost(s).

6. A copy of the order be sent to the Family Court, Raipur directly as
well as through the concerned District Judge by email and Fax for needful
and compliance.
