2 Applicant is seeking his enlargement on bail

in Crime No.226 of 2019 registered with Mandrup Police

Station, Solapur for ofences punishable under Sections

306, 498A, 304B read with Section 34 of the Indian

Penal Code, 1860 (‘IPC’ for short).

3 Investigation in this case is over. I have

perused the fnal report.

4 Applicant is not a relative of the deceased.

Therefore, allegations concerning the ofences

punishable under Sections 498A and 304B of the IPC

are, prima-facie, not applicable.

5 It is alleged that the applicant had love afair

with the deceased and he used to recurringly call the

deceased on her mobile. It is alleged that the deceased

was afraid that her in-laws would come to know about

her alleged love afair with the applicant due to which,

it is alleged that she committed suicide.

6 Prima-facie, there is no material to indicate

and/or to suggest that the applicant had abetted and/or

intentionally aided the deceased to commit suicide.

That even otherwise, phone calls allegedly made by

the applicant were on the cell phone of the husband.

7 Trial in this case may not commence and/or

conclude in near future. There are no criminal

antecedents against the applicant. Hence, the following

order:

ORDER

(i) The applicant be enlarged on bail in Crime No.226 of
2019 registered with Mandrup police station, on executing
PR Bond in the sum of Rs. 25,000/- with one or two sureties
in the like amount;

(ii) The applicant shall attend the concerned Police Station
on the frst Monday of every month commencing from April,
2020 between 11:00 a.m. to 1:00 noon till the charge is
framed;

(iii) The applicant shall inform his latest place of residence
and contact number immediately after being released
and/or change of residence or mobile details, if any, from
time to time to the Investigating Ofcer of the concerned
Police Station;

(iv) The applicant shall not tamper with the evidence or
attempt to infuence or contact the complainant, witnesses
or any person concerned with the case;

8 The application is accordingly disposed of.

9 It is made clear that observations made hereinabove

be construed as expression of opinion only for the purpose

of granting bail and the same shall not in any way

infuence the trial in other proceedings.
