ORDER

The petitioner seeks anticipatory bail in relation to his involvement as

the sole accused in the instant Crime No. 230/2019 of Kolavalloor Police

Station, Kannur District which has been registered for offences punishable

under Secs. 498A and 406 of the SectionIPC on the basis of the FI statement given

by the lady defacto complainant (petitioner’s wife) on 02.05.2019 at 5.30

pm in respect of the incident which happened for the period from

30.04.2018 to 20.12.2018.

2. The learned Prosecutor would now submit on the basis of the

instructions of the investigating agency that now the investigation has been

finalised and the final report/charge sheet has also been duly filed before

the Chief Judicial Magistrate Court, Thalassery, where it is now pending as

calendar case C.C.No.698/2019. The learned Prosecutor further submit

that in view of these subsequent developments, the investigating agency

does not insist for the arrest of the petitioner for the investigation of the

abovesaid crime as the said investigation has already been finalised and so,

the apprehension raised by the petitioner that he could be arrested and

remanded on account of the pending investigation etc. is unfounded. In

the light of these aspects, it is for the petitioner to work out his remedies in

accordance with the law.

Accordingly, the above application will stand disposed of.
