Shri R.N. Dixit, learned counsel for the respondent.

Both the parties are personally present.

Despite of best efforts made by us and the efforts by the

respective counsel, respondent is not ready to reconcile. She is still

insisting that she will not compromise qua the appeal pending in the

matter arising from the judgment by the Trial Court in respect of

Sectionsection 406 Indian Penal Code which in law is compoundable.

In view whereof, mediation fails.

Being an admitted Appeal, let the same be set out for hearing

in due course.

At this stage appellant submits that he comes along with the

Jewellery and apprehends danger as respondent’s brother namely

Shri Sanjeev Kaul, who is Inspector in the Police Department is

personally present in the Court and may cause harm to him when he

travel back to Delhi.

Though, the respondent has raised an objection and stated that

her brother is not Inspector in the Police Department, but he is an

Assistant Commandant in 13th Battalion, SAF. However, she does

not dispute that he is personally present in the Court today.

Taking into consideration the apprehension expressed by the

appellant, we request Shri F.A. Shah, learned Government Advocate

to seek instructions from the Superintendent of Police, Gwalior for

providing safe passage to the appellant from Gwalior to Delhi.

Let matter be placed on Board at 2:30 PM.

instructions from Superintendent of Police Gwalior that security has

already been provided to the Appellant.

In view whereof, no further order in the said context is

warranted.

Being an admitted Appeal, list the matter for hearing in due

course.
