Heard on the question of admission.
Shri Swapnil Sharma, public prosecutor accepts notice on behalf of
the respondent/State and, therefore, no notice is necessary.

Also heard on I.A.No.2914 of 2018, an application for suspension of
jail sentence of the appellant who has been convicted under Section 354,
IPC has been sentenced to undergo 6 months RI with fine of Rs.1000/- and
under Section 3(1)(w)(i) of SC/ST (Prevention of Atrocities) Act, 1989 and
has been sentenced to undergo 6 months RI with fine of Rs.1000/- with
default stipulation on each count.

On due consideration of the totality of the facts and circumstances,
so also the fact that the sentence of the appellant’s has been suspended by
the trial court till 17.5.2018, without expressing any opinion on merits of
the case, I.A.No.2914/2018, is allowed and it is directed that the
substantive jail sentence of the appellant Magan @ Magniram, shall remain
suspended till the final disposal of the appeal upon his depositing the fine
amount and on furnishing a personal bond to the tune of Rs.25,000/- with
one solvent surety in the like amount to the satisfaction of the trial court,
for his appearance before this court on 21.8.2018 and all other subsequent
dates as may be fixed in this behalf.

Record of the court below be called for.

List for final hearing in due course.
