In Re:- An application for anticipatory bail under Section 438 of
the Code of Criminal Procedure filed on 06.06.2018 in connection
with Islampur P. S. Case No.1176 of 2016 dated 06.12.2016 under
Sections 498A/313/307/34 of the Indian Penal Code read with
Section 3 of the Dowry Prohibition Act.

Heard the learned Counsels appearing on behalf of the

petitioners and the State.

It is submitted on behalf of the petitioners that they are the

in laws of the victim housewife and it is submitted that she did not

suffer any burn injuries and there is no forcible abortion.

Learned Advocate appearing for the State produces the Case

Diary and opposes the prayer for bail.

Having considered the materials in the Case Diary and

bearing in mind the nature of allegations in the light of the

aforesaid submissions made on behalf of the petitioners, we are of

the opinion that the petitioners may be granted anticipatory bail.

Accordingly, we direct that in the event of arrest the

petitioners, namely, Mahitosh Mandal and Mina Mondal shall be

released on bail upon furnishing a bond of Rs.10,000/- each with

two sureties of like amount each to the satisfaction of the arresting

officer and subject to the conditions as laid down under Section

438(2) of the Code of Criminal Procedure, 1973 and on further

condition that the petitioners shall appear before the court below

and pray for regular bail within a fortnight from date.

This application for anticipatory bail is, thus, disposed of.
