Prayer in this petition filed under Section 439 Cr.P.C. is for

grant of regular bail to the petitioner in FIR No.141 dated 08.09.2018 under

Section 354 IPC and Section 8 of the Protection of Children from Sexual

Offences Act, 2012, registered at Police Station Sadar Nabha, District

Patiala.

The allegation against the petitioner is that he has outraged the

modesty of minor girl between the period from 16.08.2018 to 18.08.2018.

Learned State Counsel, on instructions from ASI Baljit Singh,

states that during trial, 05 witnesses have been examined which includes the

complainant and the victim, but they have not supported the case of the

prosecution.

Heard learned counsel for the parties.

Admittedly, petitioner is in custody since 30.09.2019. The

complainant and the prosecutrix have not supported the case of the

prosecution. Trial in the case is not likely to be concluded in the near

future. Thus, this Court deems it appropriate to admit the petitioner on bail.

Accordingly, the present petition is allowed and the petitioner

is admitted on regular bail, subject to his furnishing adequate bail bonds/

surety bonds to the satisfaction of trial Court.
