O R D E R

The petitioner has been arrayed as sole accused in crime no. 225 of

2019 of Vandiperiyar Police Station which has been registered for offences

under Sectionsections 323 and Section498A of the IPC on the basis of the complaint of the

lady defacto complainant/victim in this case who is the wife of the

petitioner accused.

2. The prosecution case in short is that on 21/05/2019, at about

10.30 pm in the night, petitioner had harassed and committed cruelty on

her and had also caused bodily injury on her etc. On being queried,

Prosecutor would state that the medical records show that the victim has

suffered perdition on the right maxillary region on the face. The offence as

per Sectionsection 323 of the IPC is bailable. The non-bailable offence against the

petitioner is that under Section 498(A) of the IPC. Having regard to the

facts and circumstances of the case, it is ordered that in case the petitioner

is arrested in relation to the above said crime, he shall be released on bail

on executing bond for Rs.40,000/- and on his furnishing two solvent

sureties for the like sum, both to the satisfaction of

the investigating officer concerned.

3. However the grant of bail may be subject to the following

conditions.

(i) The petitioners shall not involve in any criminal offences of similar

nature.

(ii) The petitioner shall fully co-operate with the investigation.

(iii) The petitioner shall report before the investigating officer as and
when required in that connection.

(iv) The petitioner shall not influence witness or shall not tamper or
attempt to tamper evidence in any manner, whatsoever.

(v) If there is any violation of the abovesaid conditions by the
petitioner then the jurisdictional court concerned stand hereby
empowered, to consider the plea for cancellation of bail at the
appropriate time.

With these observations and directions, the above Bail Application

will stand disposed of.
