In Re:- An application for bail under Sectionsection 439 of the Code of
Criminal Procedure filed on 16.08.2019 in connection with
Patashpur Police Station Case No. 18/2019 dated 13.1.2019 for
alleged offence punishable under Sections 498A/Section304B/Section34 of the
Indian Penal Code and under Sections 3/ Section4 of the Dowry
Prohibition Act.

The petitioner seeks bail in connection with Patashpur Police

Station Case No. 18/2019 dated 13.1.2019 for alleged offence

punishable under Sections 498A/Section304B/Section34 of the Indian Penal

Code and under Sections 3/ Section4 of the Dowry Prohibition Act.

Learned advocate for the State raises objection against the

prayer for bail.

On perusal of the Case Diary, we do not find anything directly

attributable to this accused person. We are further informed that

husband is now on bail.

The accused petitioner is in custody for over 67 days. We do

not find any justification for further custodial interrogation in this

case. We are, therefore, inclined to release the petitioner on bail.

Accordingly, we grant bail to the petitioner upon furnishing a

bond of Rs.10,000/- (Rupees ten thousand only) with two sureties

of like amount each, one of whom must be local, to the satisfaction

of Learned Additional Chief Judicial Magistrate, Contai on

condition that petitioner shall appear before the trial court on

every date of hearing and shall not intimidate witnesses or tamper

with evidence in any manner whatsoever and shall not commit

similar offence in future, failure of any of such conditions, the

learned Court below shall be at liberty to cancel the bail without

any further reference to this Court.

C.R.M.7558 of 2019 stands disposed of.

A certified copy of this order be immediately made available to

the petitioner subject to compliance of all requisite formalities.
