439 OF CR.P.C PRAYING TO ENLARGE THE PETITIONER
ON BAIL IN CR.NO.201/2018 OF THALAGHATTAPURA
POLICE STATION, BENGALURU CITY FOR THE OFFENCES
P/U/S. 498-A, 304-B OF IPC.

THIS CRIMINAL PETITION COMING ON FOR ORDERS
THIS DAY, THE COURT MADE THE FOLLOWING:

ORDER

Thalagattapura Police have charge sheeted the

petitioner in Crime No.201/2018 of their Police Station

for the offences punishable under Sections 498A, 304B,

of Indian Penal Code.

2. Marriage of the petitioner and deceased

Veena @ Vinutha was solemnized in the year 2013. The

couple have daughter aged 4 years and son aged 9

months. Veena @ Vinutha has committed suicide in the

house of the petitioner during the intervening night of

15-16/07/2018 by handing herself.

3. It is alleged that petitioner subjected the

deceased to physical and mental cruelty in connection

with his demand of Rs.10,00,000/-.

4. The post mortem report states that there

were no external injuries on the dead body. The death

is suicidal one. The charge sheet is already filed and all

the incriminating materials including alleged suicide

note are seized.

5. Majority of the witnesses to speak to the

cruelty are the relatives of the victim. Therefore, the

chance of the petitioner tampering them are remote.

6. Petitioner is in judicial custody since

17.07.2018. Under these circumstances, it is a fit case

to grant bail with suitable conditions. Therefore,

petition is allowed.

Petitioner is granted bail in Crime No.201/2018 of

Thalagattapura Police Station, subject to the following

conditions:

1) The petitioner shall execute personal
bond in a sum of Rs.50,000/- and
furnish one surety in the like-sum to the
satisfaction of the concerned Court for
his appearance;

2) He shall appear before the Court as and
when required for the purpose of trial;

3) He shall not tamper the prosecution
witnesses in any manner.
