Judgments of Supreme Court of India and High Courts

Manjinder Singh vs Jasjit Kaur on 1 June, 2018

222 CMM-159-2018 and FAO-M-278-2014

MANJINDER SINGH
V/S
JASJIT KAUR

Present: Ms. G.K. Mann, Advocate, for the appellant.

Mr. Karan Gupta, Advocate, for the respondent.

*****

CMM-159-2018

An application has been filed by the appellant-husband for

grant of maintenance pendente lite from the respondent-wife claiming that

the respondent is working as Block Extension Officer, Primary Health

Centre, Patiala and getting sum of Rs.58,000/- per month and she is wrongly

getting maintenance from this Court. He seeks maintenance pendente lite @

Rs.15,000/- per month.

We have considered the facts and circumstances and are of the

opinion that the application deserves to be dismissed as it is merely an

excuse to effect the payment of arrears of maintenance which is

accumulated to the extent of more than Rs.2 lac. It is not a case where the

appellant-husband is not able to survive on account of want of finances. He

has got liability to pay the maintenance during pendency of the case to the

wife as well as to maintain the daughter who is being looked after by the

respondent-wife.

Application is dismissed with costs of Rs.2000/-.

FAO-M-278-2014

Parties are present in person.

Attempt made for bringing about reconciliation failed.

In order to determine whether there is any feasibility of

reconciliation, both the parties have been permitted to talk to each other for
