Respondent is duly served through mother but has not come
present. He be proceeded ex parte.
Petitioner seeks transfer of a petition filed under Section 25 of
the Guardian and Wards Act, 1890, titled as “Rajesh vs Manju Devi”,
pending in the Court of learned District Judge, Family Court, Hisar to the
Court of learned District Judge, Family Court, Rohtak.
It is stated that earlier respondent has filed divorce petition,
which was transferred by this Court to Rohtak Courts, vide order dated
07.12.2016, passed in TA No.825 of 2016. The minor child, whose custody
is sought, is living with the petitioner at Rohtak. The petition for the
custody of the minor child has been filed only to harass the petitioner.
Considering the fact that the minor child is living with the
petitioner and also the fact that other litigation between the parties is also
pending at Rohtak Courts, the present petition filed under Section 25 of the

Guardian and Wards Act, 1890, titled as “Rajesh vs Manju Devi”, pending
in the Court of learned District Judge, Family Court, Hisar, is withdrawn
from the said Court and transferred to the Court of learned District Judge,
Family Court, Rohtak.
As such, the present petition is allowed.
