5.LearnedadvocatefortheapplicantshastakenthisCourt
throughthefactualmatrixarisingoutofthepresent
application.

6.Attheoutset,itissubmittedthatthepartieshave
amicablyresolvedthedispute.Insupportofsuchsubmission
madeatbarbythelearnedadvocatesappearingforthe
respectiveparties,theyhaveplacedonrecordaffidavitsof
settlementofdisputedulysignedbytherespondentNo.2-
originalcomplainant,whoispresentbeforetheCourt.The
respondentNo.2hasfiledtheaffidavitsinGujarataswellasin
Englishlanguage.

7.Sincenow,thedisputewithreferencetotheimpugned
F.I.R.issettledandresolvedbyandbetweenpartieswhichis
confirmedbytheoriginalcomplainantthroughherlearned
advocate,thetrialwouldbefutileandanyfurthercontinuation
ofproceedingswouldamounttoabuseofprocessoflaw.
Therefore,theimpugnedF.I.R.isrequiredtobequashedand
setaside.

8.Resultantly,thisapplicationisallowed.ImpugnedF.I.R.
beingC.R.No.I-83of2018registeredwithSaylapolicestation,
Surendranagaragainstthepresentapplicantsishereby
quashedandsetaside.Ruleismadeabsolutetotheaforesaid
extent.Directserviceispermitted.
