HON’BLE MR. JUSTICE SANDEEP MEHTA
Judgment / Order
02/11/2017

The present second application for bail has been filed under

Section 439 Cr.P.C. on behalf of the petitioner, who is in custody in

relation to F.I.R. No.66/2013, Police Station Chitava, District

Nagaur, for the offences under Sections 498A, 304B and 302 I.P.C.

The earlier bail application preferred on behalf of the

petitioner was dismissed by this Court on 24.3.2017 directing the

trial court to expedite the trial. Total 29 witnesses were cited by

the prosecution in its calendar. Till date, only 9 witnesses have

been examined by the trial court.

Having regard to the gravity of the circumstances, I am not

inclined to enlarge the petitioner on bail. But considering the fact

that the petitioner is in jail from 1.7.2013, the trial court is

directed to conclude the trial positively within a period of six

months from the date of receipt of copy of this order.

With these directions, this second application for bail is

dismissed.
