This is an application under Section 482 read with

Section 401 of the Code of Criminal Procedure filed by the

petitioners being the husband and in-laws of the opposite

party no. 2 praying for quashing of the proceedings being G.R.

Case No. 1274 of 2016 arising out of Beldanga Police Station

Case No. 140 of 2016 dated March 25, 2016 under Sections

498A/366/376/34 of the Indian Penal Code pending before

the learned Chief Judicial Magistrate, Murshidabad.

Learned counsel appearing for the petitioners submits

that the present criminal proceedings as mentioned above is

the counter-blast of the FIR lodged by the petitioner no. 5,

Urbasan Bibi, the mother-in-law of the present opposite party

no. 2.

The further contention of the learned counsel for the

petitioners is that the investigation was not properly done

regarding allegations contained in the FIR.

Having regard to the submissions made by learned

counsel appearing for the petitioner and considering the

materials placed on record, the petitioner is directed to serve

the copies of the present revisional application along with all

annexed documents to the opposite party no. 1/the State of

West Bengal through the office of the learned Public

Prosecutor and to the opposite party no. 2 by speed post with

acknowledgement due within one week from date and to file

affidavit-of-service within two weeks thereafter.

Let the matter appear in the list under the same

heading “Listed Motion” three weeks hence.

Liberty is given to pray for stay upon service of notices

to the opposite parties.

Urgent photostat certified copies of this order, if applied

for, be given to the parties upon compliance of all necessary

formalities.
