beforethelearnedTrialCourt.Thedocumentsprimarilysoughttobeplaced
andrelieduponvidethisapplicationwhicharenotpartofthechargesheet

arethemessagesgeneratedfromthecloneofthemobilephonesdeposited
withtheFSL,clonecopyofwhichthepetitionerhasreceivedpursuantto
theorderofthelearnedTrialCourtonanapplicationfiledunderSection91
Cr.P.C.Itisthecaseofthepetitionerthatthedeceasedwasunder
depressionduetoherhecticworklifestylewhichfactwasacknowledgedby
hermotherandwasundergoingtreatmentfromaDoctorinChandigarh.
Furthertheallegationsofcrueltyarebaseless.Therewasnodemandof
dowryeverandquarrelsbetweenthespouseswerealsoduetoprovocation.
Thepetitionerseekstoplaceonrecordsomeofthecopiesofthewhatsapp
transcriptionsbetweenR.S.Batraandthepetitioner,NillumBatraandthe
petitionerandKaranBatraandthepetitionerandrelevantextractsof
conversationbetweenthedeceasedandthepetitionerretrievedfromhis
mobilephone.Besidesthesedocumentswhichwerenotpartofcharge-
sheet,petitionerhasalsosoughttoplacerelianceondocumentswhichform
partofcharge-sheetlikecopyofthepost-mortemreport,copiesofthe
statementsandsupplementarystatementsofR.S.Batraandcopyofthe
whatsappexchangedbetweenSeemaMalikandthedeceasedasreliedbythe
prosecutioninthecharge-sheet.

2.Whenthisapplicationcameupon14thJanuary,2019thisCourtissued
noticetothelearnedStandingCounsel,timetofilereplywithinoneweek
wasgrantedandthebailapplicationwaslistedon1stFebruary,2019.

3.On1stFebruarylearnedStandingCounselobjectedthatthepetitioner
hasnotplacedonrecordthecompletematerialreceivedbyhimastheclone
copypursuanttotheordersdated15thSeptember,2018and3rdNovember,
2018passedbythelearnedMetropolitanMagistrate.Learnedcounselforthe
petitionerthussoughtleavetoplaceonrecordtheentiretranscript.

4.ThesecondobjectionoftheStandingCounselwasthathewasnot
certainwhethertranscriptssoplacedonrecordweretrueandcorrectcopies
fromtheclonecopiesreceivedfromtheFSLandthatthisfactcouldnotbe
ascertainedonthebasisofaffidavitofthepetitionerorhisparokar.Learned
StandingcounselalsostatedthathewouldrequiretofilebeforethisCourt
transcriptsoftheclonenotonlywhichhavebeengiventothepetitionerbut
alsooftheothermobilephones,I-Padandlaptoprecoveredandseized.
ThereforetoallayanyapprehensionofthelearnedStandingCounselforthe
Stateastowhetherthematerialplacedonrecordwasthetranscriptofthe
clonecopiesreceivedfromFSL,DirectorFSLwasdirectedtoprovidethe
clonecopiesofhard-diskofallthephones,I-Pad,laptopsrecoveredand
seizedanddepositedwiththeFSLtotheinvestigatingofficerwithintwo
weekswhereaftertheinvestigatingofficerwastofindoutwhetherthe
transcriptfiledbythepetitionerbeforethisCourtwasthesameornotandin
casethesameisnotcorrect,thecorrectedcopyofthesamewasdirectedto
befiledalongwiththetranscriptoffurtheradditionalmaterialssoreceived
fromtheclonecopiesreceivedfromtheFSL.

5.On28thFebruary,2019learnedStandingCounselstatedthatPara4
and5oftheearlierordercouldnotbecompliedwithbecausetheFSLcould
notretrievethematerialfromtheI-PadandtheI-Phoneofthedeceasedfor
wantofpassword.Hefurtherstatedthatheneededtwomonthstimeto
retrievethepasswordandopenI-PadandI-Phoneofthedeceased
whereafteronlyanalysiscanbedonebytheFSLandnecessarydocuments
placedonrecord.

6.Inresponselearnedcounselforthepetitionersubmittedthatall
recordsofthedeceasedandaccusedwereinpossessionoftheinvestigating

agencysince16thJuly,2018.Onlyafterthepetitionersoughtpreservation
ofrecordsthattheinvestigatingofficersenttheI-Phones,I-Padsandlaptops
totheFSLandthemaincharge-sheetandsupplementarycharge-sheetwas
filedwithouttheclonecopies.Further,whenthepetitionersoughttheclone
copyofhisphonetoshowwhathiscasewas,theinvestigatingofficeron4th
December,2018madeastatementbeforethelearnedTrialCourtthatthe
clonecopyofthemobilephonewasnotrequiredforinvestigation.Learned
counselforthepetitionerthussubmittedthatinvestigatingagencyhaving
alreadyexerciseditsoptionstatingthatthematerialsenttotheFSLwas
irrelevanttotheinvestigation,theycannotnowseektorelyonthesame.

7.AfterhearinglearnedcounselsforthepartiestheCourtgranted
furtherfourweekstimetoStatetofilewhatevermaterialitsowishesto
placeonrecordwhereaftertheBailApplicationwastobeheardonmerits.

8.ObjectionsoflearnedcounselfortheStateandthecomplainanttothe
documentsfiledalongwiththisapplicationarethatthedocumentsbeing
beyondthecharge-sheetthesamecannotbelookedintoinviewofthe
decisionoftheSupremeCourtreportedas(2005)1SCC568Debendra

9.ThoughtheBailApplicationcanbedecidedevenwithoutconsidering
theadditionaldocumentsplacedonrecord,howeversincealegalissue
arisesandneedsdetermination,thisCourtisproceedingtodecidethis
applicationbeforedecidingtheBailApplicationonmerits.

10.Bywayoftheapplicationthepetitionernotonlyseekstoplaceon
recordthedocumentsalongwiththecharge-sheetbutalsotranscriptsofthe
messagesfromhismobilephonereceivedpursuanttoanapplicationfiledby

thepetitionerunderSection91Cr.P.C.whicharetheclonecopyofthe
petitioner’sownmobilewhichwouldhaverevealedhisconversationson
whatsappwiththedeceasedandherfamilymembers.Restofthedocuments
soughttobeplacedonrecordbythepresentapplicationarepartofcharge-
sheetandthusnoobjectionhasbeenraisedquathesaiddocuments.As
notedabove,theprosecutionneverintendedtorelyuponthesedocuments
i.e.thetranscriptsfromtheclonecopiesofthemobilephonesthoughthese
mobilephones,I-Pads,laptopswereseizedduringthecourseof
investigationbutweresenttotheFSLonlyafterthepetitionerfiledan
applicationunderSection91Cr.P.C.seekingrelevantdocuments.

11.InStateofOrissaVs.DebendraNathPadhi(supra)thethreeJudge
BenchoftheSupremeCourtheldthatatthestageofconsiderationasto
whetherthechargeisrequiredtobeframedornotagainsttheaccused,the
recordofthecaseasfiledbytheprosecutionanddocumentssubmitted
therewithcouldonlybelookedinto.ReferringtoSection227Cr.P.C.the
SupremeCourtheldthatonthereadingofSection227Cr.P.C.itisevident
astowhethertherewassufficientgroundforproceedingagainsttheaccused
hastobedeterminedbytheJudge”uponconsiderationoftherecordofthe
caseandthedocumentssubmittedtherewith”.Thusintermsofthe
ingredientsofprovisionunderSection227Cr.P.C.theSupremeCourtheld
thatthedocumentsofthedefencecannotbeproducedatthisstageand
Section91Cr.P.C.doesnotconferanyrightontheaccusedtoproduce
documentsinhispossessiontoprovethedefenceatthatstage.

12.Undisputedlyatthetimeofhearingonchargeneithercantherebea
piecemealappreciationofevidenceandthematerialanddocumentsplaced
bytheprosecutionwouldhavetobetakenonitsfacevalueandonthebasis

ofappreciationofevidencetheCourtcannotcometotheconclusionthatthe
witnessoftheprosecutionwasnotareliablewitnessunlessthewitness/
witnesseshaveenteredthewitnessboxandbeencross-examined.However
asnotedaboveinDebendraNathPadhi,theissuewhicharosefor
considerationbeforetheSupremeCourtwaswhethertheCourtcanconsider
onlydocumentswhichformpartofthecharge-sheetorevendocumentsof
thedefenceatthestageofcharge.Theissueinthepresentapplicationis
whethertheCourtcanlookintothedocumentswhichhavebeenseized
duringthecourseofinvestigationanddeliberatelykeptoutthoughmaybea
relevantmaterialduringthecourseofinvestigationandsuppliedtothe
accusedlegallypursuanttohisapplicationunderSection91Cr.P.C.while
decidingthebailapplication.

13.InD.N.Upadhyay(supra)thisCourtwasdealingwiththeissueasto
whetherdocumentsseizedbythePoliceduringinvestigationandnotrelied
uponwiththecharge-sheetcanberetainedbytheinvestigatingagencyand
notreturnedtotheaccusedorthepersonauthorizedtoretainthose
documents.ConsideringthevariousprovisionsthisCourtheldthatsincethe
documentsarenotevenreliedupondocuments/caseproperty,theCBI
cannotobjecttothereturnofthesametoitsauthorizedperson.Inthesaid
casesincetheCBIdidnotobjectthatthepetitionerwastherightfulowner
ofthedocuments,thisCourtdirectedCBItoreleasethedocumentsseizedto
thepetitionerthereinforthwith.

14.Thereisyetanotherfacettotheissueraisedintheapplicationi.e.ofa
fairinvestigationasheldbytheSupremeCourtinthedecisionreportedas
(2010)6SCC1ManuSharmaVs.State(NCTofDelhi).Theroleof
investigatingagencyduringthecourseofinvestigationistounearththetruth

andplacecompletefactsbeforetheCourt.Ifitisheldthatthedocuments
seizedbythePolicewhichinitsowndiscretionitmaynotuseandalsonot
bepermittedtobeusedbytheaccused,thesamewouldbeatravestyof
justice,forinagivencaseanunfairinvestigatingofficerwouldretainthe
documentsinfavouroftheaccusedandsincetheyarenotpartofthecharge-
sheetthesamecannotbereliedduringthecourseofthetrialasthe
prosecutionwouldnotrelyonitandtheaccusedisforbiddenasheisnotin
possessionofthedocument.Thesamewouldbeaclearcaseofprejudice.

15.Emphasizingontheessentialrequirementofafreeandfair
investigation,SupremeCourtinthedecisionreportedas(2010)6SCC1
ManuSharmaVs.State(NCTofDelhi)held:

“197.IntheIndiancriminaljurisprudence,theaccusedis
placedinasomewhatadvantageouspositionthanunder
differentjurisprudenceofsomeofthecountriesintheworld.
ThecriminaljusticeadministrationsysteminIndiaplaces
humanrightsanddignityforhumanlifeatamuchhigher
pedestal.Inourjurisprudenceanaccusedispresumedtobe
innocenttillprovedguilty,theallegedaccusedisentitledto
fairnessandtrueinvestigationandfairtrialandtheprosecution
isexpectedtoplaybalancedroleinthetrialofacrime.The
investigationshouldbejudicious,fair,transparentand
expeditioustoensurecompliancewiththebasicruleoflaw.
Thesearethefundamentalcanonsofourcriminal
jurisprudenceandtheyarequiteinconformitywiththe
constitutionalmandatecontainedinArticles20and21ofthe
ConstitutionofIndia.

198.Apersonisentitledtobetriedaccordingtothelawin
forceatthetimeofcommissionofoffence.Apersoncouldnot
bepunishedforthesameoffencetwiceandmostsignificantly
cannotbecompelledtobeawitnessagainsthimselfandhe
cannotbedeprivedofhispersonallibertyexceptaccordingto
theprocedureestablishedbylaw.Thelawinrelationto
investigationofoffencesandrightsofanaccused,inour

country,hasdevelopedwiththepassageoftime.Ontheone
hand,powerisvestedintheinvestigatingofficertoconductthe
investigationfreelyandtransparently.Eventhecourtsdonot
normallyhavetherighttointerferewiththeinvestigation.It
exclusivelyfallsinthedomainoftheinvestigatingagency.In
exceptionalcasestheHighCourtshavemonitoredthe
investigationbutagainwithinaverylimitedscope.There,on
theotheradutyiscastupontheProsecutortoensurethat
rightsofanaccusedarenotinfringedandhegetsafairchance
toputforwardhisdefencesoastoensurethataguiltydoesnot
goscot-freewhileaninnocentisnotpunished.Eveninthe
mightoftheStatetherightsofanaccusedcannotbe
undermined,hemustbetriedinconsonancewiththeprovisions
oftheconstitutionalmandate.Thecumulativeeffectofthis
constitutionalphilosophyisthatboththecourtsandthe
investigatingagencyshouldoperateintheirownindependent
fieldswhileensuringadherencetobasicruleoflaw.

199.Itisnotonlytheresponsibilityoftheinvestigatingagency
butaswellasthatofthecourtstoensurethatinvestigationis
fairanddoesnotinanywayhamperthefreedomofan
individualexceptinaccordancewithlaw.Equallyenforceable
canonofthecriminallawisthatthehighresponsibilitylies
upontheinvestigatingagencynottoconductaninvestigationin
taintedandunfairmanner.Theinvestigationshouldnotprima
faciebeindicativeofabiasedmindandeveryeffortshouldbe
madetobringtheguiltytolawasnobodystandsabovelaw
dehorshispositionandinfluenceinthesociety.

200.InKashmeriDeviv.DelhiAdmn.[1988SuppSCC482:
1988SCC(Cri)864:JT(1988)2SC293]ithasbeenheldthat
therecordofinvestigationshouldnotshowthateffortsare
beingmadetoprotectandshieldtheguiltyevenwheretheyare
policeofficersandareallegedtohavecommittedabarbaric
offence/crime.Thecourtshaveevendeclinedtoacceptthe
reportsubmittedbytheinvestigatingofficerwhereitis
glaringlyunfairandoffendsbasiccanonsofthecriminal
investigationandjurisprudence.Contraveritatemlexnunquam
aliquidpermittit:impliesadutyonthecourttoacceptand
accorditsapprovalonlytoareportwhichistheresultof

faithfulandfruitfulinvestigation.TheCourtisnottoacceptthe
reportwhichiscontralegembut(sic)toconductjudiciousand
fairinvestigationandsubmitareportinaccordancewith
Section173oftheCodewhichplacesaburdenandobligation
ontheStateAdministration.Theaimofcriminaljusticeistwo-
fold.Severelypunishingandreallyorsufficientlypreventingthe
crime.Boththeseobjectscanbeachievedonlybyfair
investigationintothecommissionofcrime,sincerelyproving
thecaseoftheprosecutionbeforethecourtandtheguiltyis
punishedinaccordancewithlaw.

201.HistoricallybutconsistentlytheviewofthisCourthas
beenthataninvestigationmustbefairandeffective,must
proceedinproperdirectioninconsonancewiththeingredients
oftheoffenceandnotinhaphazardmanner.Insomecases
besidesinvestigationbeingeffectivetheaccusedmayhaveto
provemiscarriageofjusticebutonceitisshowntheaccused
wouldbeentitledtodefinitebenefitinaccordancewithlaw.The
investigationshouldbeconductedinamannersoastodrawa
justbalancebetweencitizen’srightunderArticles19and21
andexpansivepowerofthepolicetomakeinvestigation.These
well-establishedprincipleshavebeenstatedbythisCourt
inSectionSasiThomasv.State[(2006)12SCC421:(2007)2SCC
(Cri)72],SectionState(InspectorofPolice)v.SuryaSankaram
Karri[(2006)7SCC172:(2006)3SCC(Cri)225]andSectionT.T.
Antonyv.StateofKerala[(2001)6SCC181:2001SCC(Cri)
1048].

202.SectionInNirmalSinghKahlonv.StateofPunjab[(2009)1SCC
441:(2009)1SCC(Cri)523]thisCourtspecificallystatedthat
aconceptoffairinvestigationandfairtrialareconcomitantto
preservationofthefundamentalrightoftheaccusedunder
SectionArticle21oftheConstitutionofIndia.Wehavereferredtothis
conceptofjudiciousandfairinvestigationastherightofthe
accusedtofairdefenceemergesfromthisconceptitself.The
accusedisnotsubjectedtoharassment,hisrighttodefenceis
notundulyhamperedandwhatheisentitledtoreceivein
accordancewithlawisnotdeniedtohimcontrarytolaw.

203.Itispertinenttonoteherethatoneoftheestablished
canonsofjust,fairandtransparentinvestigationistherightof

defenceofanaccused.Anaccusedmaybeentitledtoaskfor
certaindocumentsduringthecourseofenquiry/trialbythe
court.Letusexaminetheextentofthisrightofanaccusedin
lightofthestatutoryprovisionsandthemannerinwhichthe
lawhasdevelopedunderthecriminaljurisprudence.To
understandthisconceptinitsrightperspectivewemustnotice
theschemeundertheprovisionsofSections170toSection173ofthe
CriminalProcedureCode.Alltheseprovisionsfallunder
ChapterXIIoftheCodewhichdealswithinformationtothe
policeandtheirpowerstoinvestigate.

204.Thepowerofthepolicetoinvestigatefreelyandfairlyis
wellrecognisedandcodifiedinlaw.IntermsofSection170,the
investigatingofficerwhensatisfiedthatsufficientevidenceor
reasonablegroundsexistheshallforwardtheaccusedunder
custodytoaMagistratealongwithsuchweaponsorarticles
whichmaybenecessarytobeproducedbeforethecourt.
Section172oftheCodehasameaningfulbearingontheentire
investigationbyapoliceofficer.Itismandatoryforhimto
maintainadiaryunderthischapterwhereheshallenterthe
day-by-dayproceedingsintheinvestigationcarriedoutbyhim.
Heisexpectedtomentiontimeofeventsandhisdeparture,
reportingbackandclosingoftheinvestigation,theplace/places
hevisitedandthestatementsherecordedduringinvestigation.
Thestatementofthewitnessisrecordedduringthe
investigationunderSection161shallbeinsertedinthatdiary.

205.AcriminalcourtisempoweredunderSection172(2)to
sendforthediariesandtheycouldbeusedbythecourtbutnot
asevidenceinthecasebuttoaiditinsuchinquiryortrial.
However,sub-section(3)ofthesamesectionprovidesthat
neithertheaccusednorhisagentsshallbeentitledtocallfor
suchdiaries,northeyareentitledtoseethembutitisonly
wherethepoliceofficerwhomakesthemtorefreshhismemory
orthecourtusesthemforthepurposesofcontradictingsuch
policeofficersintermsofSection172thenSection161or
Section145provisionsoftheSectionEvidenceActwouldapply.

206.Section173commandstheinvestigatingagencyto
completetheinvestigationexpeditiouslywithoutunnecessary
delayandwhensuchaninvestigationiscompleted,theofficer

inchargeofthepolicestationshallforwardtoaMagistrate
empoweredtotakecognizanceofoffenceonapolicereportthe
detailsintheformasmaybeprescribedbytheState
Governmentandprovidetheinformationrequiredunderthis
section.

207.TheprovisionsofSection173(5)contemplateandmakeit
obligatoryupontheinvestigatingofficerwheretheprovisionsof
Section170applytoforwardtotheMagistratealongwithhis
report,alldocumentsorrelevantextractsthereofonwhichthe
prosecutionproposestorelyotherthanthosealreadysentto
theMagistrateduringinvestigationintermsofSection170(2)
oftheCode.Duringinvestigationthestatementrecordedunder
Section161ofallthepersonswhomtheprosecutionproposes
toexamineaswitnessesshallalsobesenttotheMagistrate.
Someelementofdiscretionisvestedwiththepoliceofficer
underSection173(6):whereheisoftheopinionthatanysuch
statementisnotrelevanttothesubject-matterofthe
proceedingsoritsdisclosuretotheaccusedisnotessentialin
theinterestsofjusticeandisinexpedientinthepublicinterest,
heshallindicatethatpartofthestatementrequestinga
Magistrate(sictoexclude)thatpartfromthecopiestobe
grantedtotheaccusedandstatinghisreasonformakingsucha
request.Sub-section(7)ofthesamesectionisindicativeof
anotherdiscretiongiventothepoliceofficerunderlawthat
wherehefindsitconvenient,hemayfurnishthecopyof
documentsreferredtoinsub-section(5)ofthesection.

208.Section173(8)empowersaninvestigatingofficertosubmit
afurtherreportifheisabletocollectfurtherevidence.Once
thisreportintermsofSection173isreceivedthecourtshall
proceedwiththetrialofthecaseinaccordancewithlaw.

209.Whatisthesignificanceofrequiringaninvestigating
officer/officerinchargeofapolicestationtomaintainadiary?
Thepurposeandtheobjectseemstobequiteclearthatthere
shouldbefairnessininvestigation,transparencyandarecord
shouldbemaintainedtoensureaproperinvestigation.

thatthecriminalcourtmaysendforthepolicediariesofacase

asevidenceinthecasebuttoaidinsuchinquiryortrial.It
seemstotheCourtthatthelearnedJudgewasinerrorin
makinguseofthepolicediariesatallinhisjudgmentandin
seekingconfirmationofhisopiniononthequestionof
appreciationofevidencefromstatementscontainedinthose
diaries.Theproperuseofdiarieshecouldmakeintermsof
Section172CrPCbyelucidatingpointswhichneed
clarification.TheCourtinthiscasewasprimarilyconcerned
withtheargumentthatthediarieswerenotproduced.

courthasusedtheseentriesforthepurposeofcontradicting
suchpoliceofficercannotbesaidtobeunreasonable.Thiswas
treatedtobeaveryimportantsafeguardasthelegislaturehas
reposedcompletetrustinthecourtwhichisconductingthe
inquiryorthetrialandhasempoweredthecourttocallfor
thesediariesthereforetherightoftheaccusedisnotunfettered
butinfactislimitedasnoticed.

214.Usefully,referencecanalsobemadetothejudgmentof
thisCourtinSectionShamshulKanwarv.StateofU.P.[(1995)4SCC
430:1995SCC(Cri)753:AIR1995SC1748]whereinthis
CourtwhileissuingdirectionforrequiringtheStatetomakea
generalhearingintermsofSection172oftheCodeclearly
statedthatitwasmandatoryforthepoliceofficer-in-chargeto
maintainthediaryintermsofthesaidprovisionandthereis
jurisdictioninSectiontheCriminalCodetocallsuchdiariesandmake
useofthemnotasevidencebutonlytoaidsuchinquiryortrial.
Itisgenerallyconfinedtoutilisetheinformationthereinas
foundationforthequestionputtothewitnesses,particularly,to
thepolicewitnesseswherethepoliceofficerhasusedthe
entriestorefreshhismemoryorifthecourtusesthemforthe
purposeofcontradictingsuchpoliceofficerthenprovisionsof
Sections161or145,wouldbeapplicable.Therightofthe
accusedtocross-examinethepoliceofficerwithreferencetothe
entriesinthegeneraldiaryisverymuchlimitedinextentand

isvestedwiththepowerofmakinguseofthestatements
recordedduringinvestigationforthepurposesofcontradiction
andcopiesthereoftheaccusedisentitledtoseeintermsof
Section207oftheCode.(SectionSeeStateofKeralav.Babu[(1999)4
SCC621:1999SCC(Cri)611]andSectionStateofKarnatakav.K.
YarappaReddy[(1999)8SCC715:2000SCC(Cri)61].)

215.Asisevidentfromtheconsistentlystatedprinciplesoflaw
thatrightoftheaccusedinrelationtothepolicefileandthe
generaldiaryisaverylimitedoneandiscontrolledbythe
provisionsaforereferredto.Butstilltheaccusedhasbeen
providedwithdefiniterightsundertheprovisionsSectionoftheCode
andtheconstitutionalmandatetofacethechargeagainsthim
byafairinvestigationandtrial.Fairnessinboththeseactions
essentiallyneedstobeadheredto.

216.UnderSection170,thedocumentsduringinvestigationare
requiredtobeforwardedtotheMagistrate,whileintermsof
Section173(5)alldocumentsorrelevantextractsandthe
statementrecordedunderSection161havetobeforwardedto
theMagistrate.Theinvestigatingofficerisentitledtocollectall
thematerial,whichinhiswisdomisrequiredforprovingthe
guiltoftheoffender.Hecanrecordstatementintermsof
Section161andhispowertoinvestigatethematterisavery
wideone,whichisregulatedbytheprovisionsSectionoftheCode.The
statementrecordedunderSection161isnotevidenceper
seunderSection162oftheCode.Therightoftheaccusedto
receivethedocuments/statementssubmittedbeforethecourtis
absoluteanditmustbeadheredtobytheprosecutionandthe
courtmustensuresupplyofdocuments/statementstothe
accusedinaccordancewithlaw.UndertheprovisotoSection
162(1)theaccusedhasastatutoryrightofconfrontingthe
witnesseswiththestatementsrecordedunderSection161ofthe
Codethusindivisible.

217.Further,Section91empowersthecourttosummon
productionofanydocumentorthingwhichthecourtconsiders

necessaryordesirableforthepurposesofanyinvestigation,
inquiry,trialoranotherproceedingundertheprovisionsSectionofthe
Code.WhereSection91readwithSection243saysthatifthe
accusediscalledupontoenterhisdefenceandproducehis
evidencetherehehasalsobeengiventherighttoapplytothe
courtforissuanceofprocessforcompellingtheattendanceof
anywitnessforthepurposeofexamination,cross-examination
ortheproductionofanydocumentorotherthingforwhichthe
courthastopassareasonedorder.

218.Thelibertyofanaccusedcannotbeinterferedwithexcept
underdueprocessoflaw.Theexpression”dueprocessoflaw”
shalldeemtoincludefairnessintrial.Thecourt(sicCode)
givesarighttotheaccusedtoreceivealldocumentsand
statementsaswellastomoveanapplicationforproductionof
anyrecordorwitnessinsupportofhiscase.Thisconstitutional
mandateandstatutoryrightsgiventotheaccusedplacean
impliedobligationupontheprosecution(prosecutionandthe
Prosecutor)tomakefairdisclosure.Theconceptoffair
disclosurewouldtakeinitsambitfurnishingofadocument
whichtheprosecutionreliesuponwhetherfiledincourtornot.
Thatdocumentshouldessentiallybefurnishedtotheaccused
andeveninthecaseswhereduringinvestigationadocumentis
bonafideobtainedbytheinvestigatingagencyandinthe
opinionoftheProsecutorisrelevantandwouldhelpinarriving
atthetruth,thatdocumentshouldalsobedisclosedtothe
accused.

219.TheroleandobligationoftheProsecutorparticularlyin
relationtodisclosurecannotbeequatedunderourlawtothat
prevalentundertheEnglishsystemasaforereferredto.Butat
thesametime,thedemandforafairtrialcannotbeignored.It
maybeofdifferentconsequenceswhereadocumentwhichhas
beenobtainedsuspiciously,fraudulentlyorbycausingundue
advantagetotheaccusedduringinvestigationsuchdocument
couldbedeniedinthediscretionoftheProsecutortothe
accusedwhethertheprosecutionreliesornotuponsuch
documents,howeverinothercasestheobligationtodisclose
wouldbemorecertain.Asalreadynoticedtheprovisionsof
Section207haveamaterialbearingonthissubjectandmake

aninterestingreading.Thisprovisionnotonlyrequireor
mandatethatthecourtwithoutdelayandfreeofcostshould
furnishtotheaccusedcopiesofthepolicereport,first
informationreport,statements,confessionalstatementsofthe
personsrecordedunderSection161whomtheprosecution
wishestoexamineaswitnesses,ofcourse,excludinganypartof
astatementordocumentascontemplatedunderSection173(6)
oftheCode,anyotherdocumentorrelevantextractthereof
whichhasbeensubmittedtotheMagistratebythepoliceunder
sub-section(5)ofSection173.Incontradistinctiontothe
provisionsofSection173,wherethelegislaturehasusedthe
expression”documentsonwhichtheprosecutionrelies”are
notusedunderSection207oftheCode.Therefore,the
provisionsofSection207oftheCodewillhavetobegiven
liberalandrelevantmeaningsoastoachieveitsobject.Not
onlythis,thedocumentssubmittedtotheMagistratealongwith
thereportunderSection173(5)woulddeemtoincludethe
documentswhichhavetobesenttotheMagistrateduringthe
courseofinvestigationaspertherequirementofSection170(2)
oftheCode.

220.Therightoftheaccusedwithregardtodisclosureof
documentsisalimitedrightbutiscodifiedandisthevery
foundationofafairinvestigationandtrial.Onsuchmatters,the
accusedcannotclaimanindefeasiblelegalrighttoclaimevery
documentofthepolicefileoreventheportionswhichare
permittedtobeexcludedfromthedocumentsannexedtothe
reportunderSection173(2)asperordersofthecourt.But
certainrightsoftheaccusedflowbothfromthecodifiedlawas
wellasfromequitableconceptsoftheconstitutional
jurisdiction,assubstantialvariationtosuchprocedurewould
frustratetheverybasisofafairtrial.Toclaimdocuments
withinthepurviewofscopeofSections207,Section243readwiththe
provisionsofSection173initsentiretyandpowerofthecourt
underSection91oftheCodetosummondocumentssignifies
andprovidespreceptswhichwillgoverntherightofthe
accusedtoclaimcopiesofthestatementanddocumentswhich
theprosecutionhascollectedduringinvestigationandupon
whichtheyrely.

221.ItwillbedifficultfortheCourttosaythattheaccusedhas
norighttoclaimcopiesofthedocumentsorrequesttheCourt
forproductionofadocumentwhichispartofthegeneraldiary
subjecttosatisfyingthebasicingredientsoflawstatedtherein.
Adocumentwhichhasbeenobtainedbonafideandhasbearing
onthecaseoftheprosecutionandintheopinionofthePublic
Prosecutor,thesameshouldbedisclosedtotheaccusedinthe
interestofjusticeandfairinvestigationandtrialshouldbe
furnishedtotheaccused.Thenthatdocumentshouldbe
disclosedtotheaccusedgivinghimchanceoffairdefence,
particularlywhennon-productionordisclosureofsucha
documentwouldaffectadministrationofcriminaljusticeand
thedefenceoftheaccusedprejudicially.

222.TheconceptofdisclosureanddutiesoftheProsecutor
undertheEnglishsystemcannot,inouropinion,bemade
applicabletotheIndiancriminaljurisprudencestrictosensuat
thisstage.However,weareoftheconsideredviewthatthe
doctrineofdisclosurewouldhavetobegivensomewhat
expandedapplication.Asfarasthepresentcaseisconcerned,
wehavealreadynoticedthatnoprejudicehadbeencausedto
therightoftheaccusedtofairtrialandnon-furnishingofthe
copyofoneoftheballisticreportshadnothamperedtheends
ofjustice.Someshadowofdoubtuponveracityofthedocument
hadalsobeencreatedbytheprosecutionandtheprosecution
optednottorelyuponthisdocument.Inthesecircumstances,
therightoftheaccusedtodisclosurehasnotreceivedany
setbackinthefactsandcircumstancesofthecase.Theaccused
evendidnotraisethisissueseriouslybeforethetrialcourt.

16.ThisCourtatthemomentisnotdealingwithSection227Cr.P.C.
whereinitisqualifiedthatuponconsiderationoftherecordsofthecaseand
thedocumentssubmittedtherewiththeCourthastoapplyitsmindwhether
thereissufficientgroundforproceedingagainsttheaccusedornot.The

“439.SpecialpowersofHighCourtorCourtofSession

custodybereleasedonbail,andiftheoffenceisofthe

18.Indubitably,ascontendedbythelearnedcounselonthebasisofthe
decisionin(2019)SCCOnline461NationalInvestigatingAgencyVs.
ZahoorAhmadShahWatalitheCourtatthetimeofgrantofbailisnotto
elaboratelyexamineordissecttheevidenceandismerelyexpectedtorecord
thefindingonthebasisofbroadprobabilitiesregardingtheinvolvementof
theaccusedinthecommissionofthestatedoffenceorotherwise.However,
inthesaidcasetheHighCourtwhilegrantingbailtotheaccusednotedthat
theevidenceintheformofstatementofwitnessesrecordedunderSection
161Cr.P.C.wasnotadmissible,norwerethedocumentspressedintoservice
bytheinvestigatingagencywereadmissibleandthatitwasunlikelythatthe
documentswererecoveredfromtheaccusedtherein,onwhichtheSupreme
CourtheldthattheapproachoftheHighCourtincompletelydiscardingthe
statementoftheprotectedwitnessunderSection164Cr.P.C.ontheground
thatthesamewaskeptinasealedcoverandnotevenperusedbythe
designatedCourt,wasincompletedisregardofthedutyoftheCourtto
recorditsopinionthattheaccusationmadeagainsttheconcernedaccusedis
primafacietrueorotherwise.

19.DuringthecourseofargumentsthisCourtposedtolearnedcounsel
forthecomplainantthatinagivencasewhereanaccusedhasbeenalleged
tohaveassaultedthecomplainantonaparticulardayandwiththeBail
Applicationtheaccusedplacesonrecordimpeccableevidenceintheformof
hisentryinthepassportshowingthattheaccusedontherelevantdatewas
noteveninthecountry,wouldtheCourtbenotboundtoconsiderthat
aspectonaverificationreceivedtocometotheconclusionthatwhetherthe

accusationagainstthepetitionerisprimafacietrueorotherwise.The
answeroflearnedcounselforthecomplainantisinthepositiveandhestates
thatsuchamaterialwouldhavetobelookedinto.

20.Inviewoftheaforesaiddiscussion,sincedocumentsbeyondthe
chargesheetsoughttobeplacedweretranscriptsoftheconversationpriorto
thedeathofAnissiabetweenpetitionerandAnissiaandherfamilymembers
whichweredulyseizedandretainedbytheinvestigatingagencyandasper
thestatementoftheinvestigatingofficernotreliedupon,cannotbeheldto
benon-permissibletobeplacedbeforetheCourtforconsideration
particularlywhenaveryfairopportunityhasbeengrantedtotheStatealso
toplaceonrecordwhatevermaterialtheStatesowishes,asalsoverifythe
genuinenessofthetranscripttowhichtilldatethereisnochallenge.
NeedlesstonotethatinresponsetothepresentapplicationtheStatehasalso
placedvoluminousrecordretrievedfromthephonesofMayank,Nillum
Batra,R.S.Batra,etc.whichhavebeentakenonrecord.Caseofthe
prosecutionisthattheI-PhoneandI-PadofAnissiaBatraispassword
protectedandthusthesamecouldnotbeopenedandhenceeffortsarebeing
madetogetthesameopened.

2.Contentionsoflearnedcounselforthepetitionerarethatthe
petitioner’smarriagetoAnissia,thedeceasedwasalovemarriage
solemnizedon23rdFebruary,2016whenthedeceasedwasapproximately37
yearsofageandpetitionerwas38yearsofageandthiswasthesecond
marriageofthepetitioner.Thedeceasedhadapriorlive-inrelationship
whichhadgonesourleadingtoherfilingacaseofrapeagainstherex-
boyfriendcontendingthathevitiatedpromiseofmarriage.Pursuanttothe
registrationofFIRon14thJuly,2018underSection304BIPC,thepetitioner
wasarrestedon16thJuly,2018andthushasbeenincustodysincethen.
Charge-sheetforoffencespunishableunderSection304B/Section498A/Section34IPCwas
filedon12thOctober,2018onwhichcognizancewastaken,followedby
filingofsupplementarycharge-sheeton31stOctober,2018.Parentsofthe
petitionerwhosurrenderedtocustodyhavealreadybeengrantedbailbythis
Courtvideorderdated20thNovember,2018.BailApplicationofthe
petitionerhasbeenrejectedbythelearnedTrialCourton15thDecember,
2018,hencethispetition.

3.Learnedcounselforthepetitionerfurthercontendsthatinthe
allegationsordocumentsthereisnoproofofanymonetarytransaction.
EventhesaleconsiderationofVasantKunjflatofthedeceasedwhichwas
sold,wasdepositedintheaccountsofthedeceasedandhermother.Thereis
noallegationofdemandofdowryinthevariouscommunicationsand
documentswhichformpartofcharge-sheetpriortothedeath.Eveninthe
emaildated23rdJune,2018toherlawyerDr.AmanHingoraniwhereinthe
deceasedhadindetailsetoutallthattranspiredduringthesubsistenceof

marriage,thereisnoallegationforharassmentinrelationtodemandof
dowryandthusthelearnedAdvocateadvisedAnissiatofileacaseof
domesticviolence.Eveninthemessagesinter-sethefamiliesthereisno
allegationthatthepetitionerorhisfamilymembersdemandedanydowry.
Thepetitionerhadtimeandagainshoweredexpensivegiftsonthedeceased
andherfamilymembers.Onthefirstweddinganniversaryhepresentedthe
deceasedwitharingworth₹16lakhsandpurchasedaBMWcarin
December2017forthedeceasedonherbirthdayforwhichinstallments
amountingto₹22lakhshavebeenpaidtillJune2018.Thepetitioneralso
gavepocketmoneytothedeceasedapproximately₹35,000/-permonth
whichfactisdulyreflectedinthebankstatementincludingthatofJuly
2018.Besidesthedeceasedwasgivenhand-bags,shoes,watches,etc.
Petitioneralsogavecostlygiftstothebrotherofthedeceased.The
petitionerstayedinrentalaccommodationatSafdarjungDevelopmentArea
(SDA)andpaidasumof₹67,000/-permonthfromFebruary2016tillJuly
2017andwasincurringday-to-dayexpenses;andfromJuly2017the
petitioneranddeceasedresidedinthehouseownedbytheparentsofthe
petitioneratN-116,1stFloor,PanchsheelPark.Eventhepersonalexpenses
ofthedeceasedweremetbythepetitioner.InApril2018thepetitionereven
offeredtogive₹1croretothedeceasedsothatshecouldbuyahouseinher
nameinDelhi.

4.Learnedcounselforthepetitionercontendsthattheinvestigationhas
beenunfairasthebankstatementsofthedeceasedwhichwouldhave
demonstratedthatthedeceasedwastransferringmoneytoherfamily
membershasnotbeenplacedonrecord.Despitethemobilephonesofthe
petitioner,deceasedandotherfamilymembersseized,conversationstherein

werenotrelieduponbytheprosecutionaswasspecificallystatedbythe
investigatingofficerwhenthepetitionerfiledanapplicationunderSection
91Cr.P.C.beforethelearnedTrialCourt.Forthefirsttimeallegationsof
dowryareintroducedinthesupplementarystatementofNillumBatraand
R.S.Batrawhereinthedatehasbeentamperedfrom11thSeptember2018to
11thAugust,2018.Theemaildated23rdJune,2018waswrittenonalegal
advicewiththeintenttoinitiateproceedingsofdomesticviolenceand
maintenanceandtheentirematerialrecordedthereinwascreatedpostthe
meetingwithalawyeronorabout9thJune,2018.Thedeceasedwasunder
depressionwhichfactstandsadmittedbyboththeparentsofthedeceased.
DeceasedhadbeenconsultingaDoctoratChandigarhandwasunder
medication.Evenontheallegationsofphysicalcrueltyreadingthevarious
conversationsitisevidentthatthedeceasedusedtofirstgetangryand
wouldalsoabuse,provokeandhitthepetitioner.Alongwiththecharge-
sheetacomplaintdated27thJune,2018hasbeenfiled,howeverthesameis
differentfromtheoneavailableonthewebsiteofQuintDNA.Admittedly
thepetitionerandthedeceasedwerelivingseparatelysince7thJune,2018
till7thJuly,2018andtherewasnoknowledgeorbeliefthattheywouldstart
residingtogether.Deceasedandpetitionerweretalkingaboutamicable
separationthroughmutualconsenttill4thJuly,2018i.e.oneweekafterthe
complaintdated27thJune,2018wasmade.

5.Thepetitionerhadalreadyexpressedhisapprehensiontothemother
ofthedeceasedthatthedeceasedwasthreateninghimthatshewouldharm
herselfandblamethepetitioner.Thoughprosecutionallegesearlier
complaintsofdomesticviolence,howeveronenquiryallthosecomplaints
werefiledastherewerenoinjuriesanditwasnotedthattherewas”kaha

Suni”betweenthehusbandandwifeondomestictalks.Furtherthesaid
callsweremadeafterthepetitionerhadmovedoutofthematrimonialhouse
andthedeceasedwasresidingwithherparents.On11thJune,2018the
petitionerevenmessagedfatherofthedeceasedthathewouldbecomingto
collecthisclothesashewantedeverythingtohappenpeacefullywithout
trouble.Petitionerhimselfrequestedthemotherofthedeceasedtocometo
Delhiinviewoftheerraticbehaviorofthedeceasedandthefightsbetween
themtowhichthedeceasedreactedadversely.

6.Ontheinterveningnightof7thand8thJune,2018motherofthe
deceasedsentamessagetoSushmaSinghvi,motherofthepetitioner,
becausethepetitionerhadalreadytoldthemotherofthedeceasedthathe
hadsavedthewhatsappmessagesbetweenthemandtocircumventthose
incriminatingmessagesacceptingherdaughter’smentalillnessshesentthe
messagetohismother.Thedeceasedandpetitionerwerenotresiding
togetherasnotedabovefrom7thJune,2018to7thJuly,2018,howeverfrom

underthesameroof.Itisonlyontheadviceoftheuncleofthepetitioner
thatthepetitioneranddeceaseddecidedtostartresidingtogetherbutin
separaterooms.Onthefatefuldaypetitionerhadlunchintheroomofthe
deceasedataround1-1.30PMwhereaftertheywentoutandshealsospoke
toSeemaMalikonphone.Oneverysmalllittleissuethedeceasedusedto
callthePCR,howeveronthatdateshedidnotmakeanyphonecallasthere
wasnoapprehension.

7.Themessagesofthedaydonotindicatethatanycrueltywas
committedbythepetitionermuchlessinthecontextofdowryharassment.
Theviscerareportofthedeceasedclearlyindicatesthatitcontainedethyl

alcohol298mg/100mlofbloodwhichcausesamnesiai.e.stageofblack
out.Versionofthedeceasedthatshewaslockedupwasimprobableonthe
perusalofthesiteplanitself.AnindependentwitnessNaveenKumar,the
constructionworkerwhohadseenAnissiasawherwithhermobileinher
handandthoughtthatshewastakingselfieandwithin2-3minuteswhenhe
lookeduphesawherhangingontheoutersideoftherailing.Hecalledhis
fellowlabourer.Inthemeantimethegirllefttherailingandfelldown.
EventheFSLteamafterinspectionofthecrimesceneopinedthat
possibilityofsuicidefallcouldnotberuledout.Intheconversation
betweenthedeceasedandhermotherinApril,2018itselfthedeceasedhad
clarifiedthatshewasbuyingtimeandwouldmoveoutonceshehadan
apartment.

8.RespondingtothestatementsofSeemaMalikandAmanHingorani
pressedinbytheState,itisstatedthatthesameareafter-thoughtandon
legaladvice.Thedeceasedhavingmadeuphermindtosuethepetitioner
andseparatefromhimonceshegetsanapartment,thedocumentsandfacts
werecreatedtoframeupthepetitioner.Respondingtotheemails/chats
petitionerclaimsthatineachoftheincidentthedeceasedhadbecome
violentandaggressiveandinheremailtothelawyerhasexaggeratedthe
facts.Thedeceasedhadearlieralsohitherselfwithabottleandreceiveda
cutonherthumbwhichinheremailhasbeenexaggeratedthatshewas
“lyinginapoolofblood”.Thefactthatthedeceasedusedtogetangryand
irkonthesmallestofthingshasbeenadmittedbythedeceasedinheremail
toDr.AmanHingoranialso.

9.LearnedStandingCounselfortheStatesubmitsthatthoughtheFIR
wasregisteredonthestatementofNillumBatra,themotherofthedeceased,

howeverthreestatementsofMaj.Gen.Batrawererecorded,twoon14thJuly,
2018;firsttotheSDMandthesecondtotheinvestigatingofficerandthe
thirdstatementi.e.supplementarystatementwasrecordedbytheI.O.on11th
August,2018.However,inadvertentlythedateof11thSeptember,2018was
notedonthestatementwhichwaslatercorrected.Thefactthatthe
statementwasrecordedon11thAugust,2018iscorroboratedbytheseizures
andvisitsofwitnesses.InhisstatementMaj.Gen.Batrahasclearlystated
thattherewasademandofmoneypriortothemarriage.Further,gold
jewelleriesandginnisweregiveninJanuary2016i.e.priortothemarriage.
WhenpetitioneranddeceasedwereontheirhoneymoonatDubai,the
petitionerassaultedAnissia,pictureswhereofweresenttoherparents.In
factNillumBatraadvisedMayankandremindedofhispromisethathe
wouldnottouchthealcoholandwouldnotraisefingeronherwhatever
maybetheprovocationandhisfirstprioritywastogetherbacksafelyand
thenoncehegetsbacktoDelhihecoulddiscussthematterwithhisparents
andletthemadvisehim.

10.LearnedStandingCounselstatesthatthemannerofcrueltywhichwas
inflictedontheAnissiaatDubaiduringhoneymooncontinuedtillthelast
datei.e.13thJuly,2018.Evenon13thJuly,2016theparentsofAnissiahad
tocalltheirdaughtertoChandigarh.InFebruary2017onthefirstmarriage
anniversarydemandsweremadebytheparents.Thepetitioneragain
assaultedAnnisiaon12thApril,2017forwhichNillumBatrasentamessage
toSushmaSinghvi,motherofMayank.On6thJune,2018Mayanknotonly
assaultedAnissiabutalsohismother-in-law/NillumBatra,whichfactisalso
mentionedintheemailtoDr.AmanHingorani.On9thJune,2018aDD

entrywaslodgedinthisregardatPSPanchsheelParkfollowedbyDDentry
No.81Aon11thJune,2018.

11.AnissiasoldherpropertyatVasantKunjon12thJune,2018outof
whichasumof₹12lakhswaskeptbyAnissiaandthebalanceconsideration
of₹1,08,00,000/-wastransferredtotheaccountofNillumBatra.Itisthe
caseoftheprosecutionintheformofstatementoffatherofthedeceased
thatafterthesaleoftheflatatVasantKunj,Mayankbecamemore
aggressive.Eveninthesecondsupplementarystatementrecordedbythe
I.O.on14thJuly,MajorBatrahadstatedthattheviolencebythepetitioner
increasedasmoneyfromthesaleoftheflatwasrefusedtobegiven.The
petitionerwentontotheextentofhackingtheemailsofAnissiawhichfact
shehadtobringtothenoticeoflearnedcounsel.Thereisampleevidencein
theformofstatementsofDr.AmanHingorani,friendsofAnissia,brotherof
AnissiaKaranBatraandtheservantwhichshowsthattherewascontinuous
physicalcrueltyonthedeceasedbythepetitioner.Eveninhermessageto
AmanHingoranion13thJulyat4.12PMAnissiastatedthatshewasgoing
tokillherselfbecauseMayankhaddrivenhertoit.Priortomakingacallto
AmanHingoranishemadeaphonecalltoSeemaMalikthatMayankhad
lockedherupandsheshouldpleasecallthePoliceifshecan.Shethensent
amessagetoSeemaMalikstatingthatshewasgoingtokillherselfthatday
becauseMayankhaddrivenhertothat.

12.InhischatsthepetitioneradmittedthatheraisedhandsonAnissia.
Notonlywasthepetitionerinflictingphysicalcrueltybutalsomentalcruelty
onthedeceasedashewasindulgingwithotherwomen,doubtingthe
characterofthedeceased,emotionallyhurtingherandtakingsteroids.
Thoughlearnedcounselforthepetitionerclaimsthatthepetitionerwasquite

well-offandneedednomoney,howeverfromtheinvestigationcarriedoutit
wasevidentthatthepetitionerhadtaken₹10lakhsfromhisfriendsanddid
notreturnthesamefor2years.EveninhersubsequentemailtoAman
HingoranishestatedthatshehadevidenceinherI-PhoneandI-Padand
wouldgiveittohim.TheI-PhoneandI-Padcouldnotbeopenedbeing
passwordprotectedandeffortsarebeingmadetoretrievethesame.

13.Learnedcounselforthecomplainantcontendsthatbeforethedeathof
Anissia,priorPCRcallsandcomplaintdated27thJune,2018wasgot
registered.Thereisoverwhelmingevidenceonrecordtoshowthatthe
petitionerhascommittedtheoffenceatleastpunishableunderSection306
IPCwhichisaseriousoffence.Statementsofpublicwitnessesnamely
KanchanSharma,NiharikaSingh,RamanAhuja,SeemaMalik,Bhawna
DuttandDr.AmanHingoraniareyettoberecorded.Theallegationsofthe
prosecutionarecorroboratedbycontemporarywhatsappmessages.The
stateofmindofthedeceasedisevidentfromthemessagessentbyhersoon
beforeherdeathtoSeemaMalikandAmanHingorani.

14.Heardlearnedcounselforthepetitioner,Stateandthecomplainantat
length.FIRNo.185/2018wasregisteredonthestatementofSmt.Nillum,
motherofdeceasedAnissiaBatrarecordedbytheSDM,HauzKhaswherein
shestatedthatshemarriedherdaughterAnissiaBatratoMayankSinghvion
23rdFebruary,2016.Afteraweekofmarriagethecouplewentfor
honeymoontoDubaiwhenontheseconddayMayankassaultedAnissiain
hotellobbyandaphotooftheinjurymarkwassentbyAnissiatoher.On
thecomplainant’sadvicethatAnissiashouldmovetoanotherroomforher
safety,onthenextday,Anissialeftthehotel,joinedafemalefriendand
cametoIndia.Onthecomplainant’sadvice,herdaughterdiscussedthe

issuewithherparents-in-lawhowever,theyaccusedAnissiaofinstigating
Mayankduetowhichthesituationbecameugly.ParentsofMayankassured
thecomplainant’shusbandthatnosuchincidentwilloccurinfutureandthat
Mayankwillalsonottakeliquor.However,withinaweek,Mayankagain
abusedandassaultedAnissiausingvulgarwordsforherwholefamily.Due
tothemisconductofMayank,thecomplainantinordertoensureher
daughter’ssafety,cametoDelhion14thApril,2018andstayedforone
month.Duringthesaidperiodalso,Mayankpulledthehandofher
daughterandtriedtothrowheroutofthehouse.Duetothebehaviorof
Mayank,herdaughterusedtoremainsad,sothecomplainantagaincameto
Delhion5thJune,2018.

15.On6thJune,2018inthenightagainaquarreltookplacebetween
themandwhenthecomplainantwenttotheroomofherdaughterandson-
in-law,shesawthatAnissiawassittingonthebedquietlywhereasMayank
wastalkingonphonetohisparents,whowereinLondon,andhisparents
wereinstigatingMayankduetowhichhebecamemadinanger.Mayankhit
herdaughterwithsuchaforcethathisbraceletalsocameoutofhishand.
Onthenextday,parentsofMayankcamebackfromLondonandcameto
thehouseofMayankintheevening.However,theywererudewiththeir
daughter-in-lawandthecomplainant.Policewascalledatthehouseon9th
June,2018.Duringthecourseofincident,sonofthecomplainantKaranjit
Batrawasalsopresent.Ontheassuranceofoneoftherelativesthatit
wouldnothappenagain,theywentbacktoChandigarh.Itisforthefirst
timethatthecomplainant’sfamilycametoknowthatMayankwasalsoa
divorceeandneededmentaltreatment.Thecomplainantalongwithher
husbandandsoncamebacktoChandigarhon29thJune,2018.Mayankwas

demandingmoneyfromherdaughteragainandagain.On13thJuly,2018at
about12.11P.M.thecomplainantsentamessagetoherdaughteron
WhatsApptoknowherwellbeingbutnoreplywasreceived.Beforethat,
herdaughteratabout11.40A.M.statedthatMayankwasinoneroomand
theywereinseparaterooms.TwomessageswerereceivedfromMayankat
2.13P.M.and2.24P.M.whereinheusedindecentwordstothe
complainant.Later,herhusbandtoldherthattheirdaughterhadjumped
fromthirdfloorandhasbeenshiftedtothehospital.Complainantsought
legalactionagainstherson-in-lawMayankandhisparents.Besidesthe
statementofthemother,theSDMalsorecordedthestatementofthefather
ofthedeceasedAnissiaBatranamelyRopinderSinghBatraanddirected
thatFIRberegisteredunderSection304BIPC.

16.Duringthecourseofinvestigation,itwasrevealedthatthedeceased
hadconsultedDr.AmanHingorani,Advocatewhosestatementunder
Section161Cr.P.C.wasrecordedon19thJuly,2018.Dr.AmanHingorani
statedthathereceivedacallfromMs.Anissiawithreferencefromone
Ms.Bhavnarequestingforanappointmenttodiscusshermatrimonial
discourseonoraround9thJune,2018.Shewashighlyagitatedatthatpoint
oftimeasaccordingtoher,shewasbeingaskedtovacatehermatrimonial
homeatN-116,PanchsheelPark,NewDelhibyherhusband.Hegave
Anissiaappointmentfor11thJune,2018andafterthediscussionAnissia
instructedhimtoprepareandfileadomesticviolencecomplaintandclaim
maintenance.Healsoaskedhertoe-mailthedetailedstatementofhercase.
On18thJune,2018,Ms.Anissiaandherparentsmethimathischamberwith
somehandwrittennotesandherdocumentsonherphone.Whenagainhe
askedhertoe-mailhimthefactschronologicallyandtogivehimhard

copiesofthedocuments.Ane-mailwassentbyAnissiatohimonthe
eveningof23rdJune,2018towhichherespondedon24thJune,2018asking
hertosendtheprescribedformatofthefinancialaffidavittohimbye-mail
andaskedhertoleaveitinhischamberby29thJune,2018dulyfiledwith
supportingdocumentsandotherdocumentsreferredtoinherstatement.
SinceDr.AmanHingoraniwastravellingfrom25thto30thJune,2018,he
advisedhertotalktoMs.PriyaHingorani,Advocateincaseshehadany
query.Onoraround27thJune,2018,AnissiaandherfathermetMs.Priya
HingoraniinthechamberandsatwithMr.HimanshuYadav,Advocateto
partlyfilluptheFinancialAffidavit.On1stJuly,2018,hereceivedfew
additionalfacts.SinceMs.Anissiahadneithersenthardcopiesnorthe
completefinancialaffidavit,hecalledherfewtimesbutshedidnotpickup
thephone.On12thJuly,2018,hereceivedacallfromAnissiastatingthat
herhusbandhadhackedhere-mailIDashehadcometoknowthatshewas
takinglegaladvicefromDr.AmanHingoraniandsuggestedhimthatin
future,theyshouldnotcommunicatethroughemail.Whenheaskedabout
thedocuments,Ms.Anissiastatedthathewouldgetthehardcopiesofthe
documentsfromthecybercafé.On13thJuly,2018atabout4.12p.m.he
receivedaWhatsAppmessagefromAnissia’sphonestating:

“IamgoingtokillmyselftodaybcozMayankhasdrivenme
toit.IwouldlikeyoutoplzfightformeafterI’mgone.”

17.FromtheWhatsAppmessagesentbyAnissiatoDr.AmanHingorani
andalsofromthestatementofoneNavinKumarwhowasworkingasa
labourerintheadjoininghouse,itisevidentthatAnissiacommittedsuicide
afterfallingfromthethirdstory.

dated23rdJune,2018sentbyAnissiatoDr.AmanHingorani.

“ImetMayankSinghviforthefirsttimeon23rdMay2015.We
metthroughafriendwhowasonadatewithhimthatevening.
Hethenstartedpursuingmelikeacrazedmanonamission
whohadtogetwhathewantstotheextentthatheeven
followedmeuptoKasuali,whereIwasspendingmyvacation
withmyfamily.Yes,Ihadjokinglysaidtohimtocomenot
realisingthathewouldactuallylandup.BeforetheKasauli
tripwhenafterour2ndmeetingIrealisedhewasshowing
greatinterestinmeIwarnedhimthatIwasinabadand
vulnerablestateatthatpointasIhadacasegoingonwhereI
hadslappeda375and313sectiononmyexboyfriend.I
madeitverywellawaretohimthatIwasstuckinthismess
andthatheshouldprobablynotgetinvolvedwithme.Atthat
timeafterhearingthisheassuredmethathewouldstandby
meandalwaysbebymysideandIhadnothingtoworry
about.Hencewestartedchattingoftenafterthatandthat’s
whentheKasaulijoketoocameup.

OnceinKasaulihespent3fulldayswithustryingnotjustto
woomebutmyfather,motherandbrothertoo.

Inamonthandahalffromthetimewemethegotmyname
tattooedonhisbackputtingtremendouspressureonmeto
considerhimformarriagewhichbythewayIhadmadevery
cleartohimthatIwasnotgoingtobeinaflimsyrelationship
butaonethatwouldleadtomarriage.Iwasataverylow
periodinmylifeafteratraumaticbreakupplusacourtcase
andwasextremelyvulnerable.Ithoughtthatifamantattoosa
girl’snameonhisbodyhewouldbeseriousandsincere.(I
spoketohisexgirlfriendNiharikawhereheappliedthesame
modusoperandioftattooinghernametoonhischestwhich
todayhehascoveredupbyanothertattoo).So,fromthatpoint

Idecidedtogivearealseriouschance.Hence,startedour
seriousrelationship.

havinghisownconsultingfirm(insightstrategies)hewas
constantlyaroundmebringingmeflowers,diningmeor
lunchingoutwithmeortakingmetomycourtdateswhenever
theycame.Hespentmanynightsatmyhouseandwould
alwaysleavelateinthemorning.Neverbefore11am,whenI
enquiredabouthisworkhetoldmethathehadsomedealings
goingonwithsomeMr.Assadforwhichheevenborrowed
about3.5lakhsfrommewhichwasmadethroughacheque
transfersoshouldn’tbedifficulttotrace(Ihadsome4lakhs
lyinginmyaccountatthetime).Iwithoutaniotaofhesitation
transferredthemoneyintohisaccounttheverynextday.This
musthavebeenaftersome2monthsofknowinghim.9months
later,Istillwentaheadandmarriedhimthinkinghewasfrom
areputedfamilywithgoodeducation.

Wegotmarriedon23rdofFeb,2016withfamiliesandfriends
frombothsidesinattendance.Wemovedintoarented
accommodationinSafdarjungDevelopmentAreawherethe
landlordwaschargingusarentofRs.67000/-permonth
whichlateronheincreasedby10%afterayear.Onthe1stof
MarchweleftforourhoneymoontoDubai.Hehadbookedus
intoSofitelJumelrah.Atthereception,hisdebitcardgot
declinedsoheaskedmetopaywithmycreditcardwhichat
thattimehadacreditlimitofapprox1.34lakhs.Thehotelbill
wasroughly95koralakh.Thefirst2daysinDubaiwere
goodthoughtherewasnotmuchintimacyorsexasitshould
normallybewhenyouareonyourhoneymoon.

fromtherestauranttothetaxiyouhadtocalltherestaurant

husbanddidn’thavethecourtesytolendmehisjacketIgota
littleangry.Anyhow,finallythecartcameandwemadeittoa
taxiandfinallytothebarthathiscousinswantedtotakeus
too.

Attheentranceofthebar,thebarattendantrefusedtoletus
in.WhenIwastryingtoreasonwithherMayankcamefrom
thesideandwhisperedintomyearbesharamauratkeepquiet.
Iwasinshockastohowcomemyownhusbandcouldsay

daysthatwewerewehadnosexualrelationsandon31stnight
weagainfought.ReasonbeingMayankandIhadgonetothe
beachtoseethefireworks.Yeswewerebothacoupleof
drinksdown.Oncethefireworkswereoverwegotbacktothe
hotel(hardrockcafe)around12:45am.Thehotelhaddone
theirownnewyeararrangementswithmusicanddrinksand
food.Thepartywasalivethereandeverybody(thehotel
guests)weredancingtothebeatsofEnglishretromusic.They
wereplayingthekindofmusicwhichIthoroughlyenjoysoI
askedMayankletssitforawhilehere,haveanotherdrinkand
thenretireforthenight.Mayankdoesn’tdancethoughthat’s

werecontinuingoverthephone.

IgotbacktoDelhionthe5thofMayandourservantranaway
withstolencashonthe6th.Withoutaservantandhavingadog
andajobwhichrequiredmetogetawayfordaysonandputa
lotofpressureonme.Anyhowsomehowcontactedtheseand
afterafewdaysgotanewservant.

Mayankhadalwaysbeenveryfondofcars.Whenhewasin
BombayheownedaMercedesandaHondacivic.Whenhe
movedtoDelhiheimmediatelywentandboughtanAudiA6so
nowthathisnewcompanywaspayinghimwellhedecidedto
sellhisA6andbuyabrandnewMercedesBenzE350which
wasjustlaunchedintheIndianMarket.On31stofMaywe
tookitsdeliveryandgotithometoSDAwherewewerestill
residingatthemoment.

FinallyendofJuly2017wemovedtoN116,PanchsheelPark
wheretilldatemeandMayankareresiding.

Ipackedandmovedthewholehousemyselfwithoutanyhelp
fromMayankashisexcusewasthatI’mworkingorI’m
gymingorI’mtiredaftercomingbackfromboth.Duringthis
entireperiodofmovingweobviouslykeptfightingasItoowas

onlegaladvice,itisevidentthatthereareatleastfiveinstanceswherethe
petitionerhasinflictedphysicalcrueltytothedeceasedi.e.firstlyatDubai
whentheywentfortheirhoneymoonthereafteron13thJuly,2016,12th
April,2017,30thMay,2017and6thJune,2018whenitisallegedthatnot
onlydidthepetitionerassaultthedeceasedbutalsohermother.Thoughthe
caseofthepetitioneristhatthesaidphysicalassaultwheneverwasona
provocationbythedeceased,whichononeoccasionthedeceasedhadalso
admitted,howevertheprovocationifanydoesnotgivealeewaytothe
petitioner/thehusbandtoinflictphysicalcrueltyonthewife.

22.BesidesphysicalcrueltytheemailofthedeceasedaddressedtoDr.
AmanHingoranialsoshowmentalharassment.Thepetitionerhasbeen
repeatedlyusingwordslike”Randi”,”BeshramAurat”,”disgusting”,
“Batakiskesaaththee”,”teriorterifamilykiaukatkyahai”,padirehtihai
yahanbeshramkiterah”,”aukathaichampagnepeeneki”,etc.

23.Caseofthepetitionerhavinggonethroughhiswhatsappmessagesis
thatthedeceasedwassufferingfromdepressionandundergoingtreatment
fromaDoctoratChandigarhwhichwascausingtemperamentaldifferences
andherbehaviorwasprovocative.Despiteeveryeffortmadebythe
petitionertoreconcileandensurepeaceandharmony,thesituationwouldbe
createdinamannerresultinginescalationofdifferences.Thepetitionerhas
alsocanvassedthatwhenthedeceasedcommittedsuicide,heralcohollevel
aspertheviscerareportwasveryhighi.e.ethylalcohol298.00Mg/100ML
ofbloodandtherangeof200-300resultsinamnesia-blackout.Learned
counselforthepetitioneralsocontendedthatdespiteAnissia/thedeceased
havingmessagedtoherfriendSeemaMalikandherlawyerDr.Aman
Hingoranithatshewasgoingtocommitsuicide,noonecametoherhelp
whichshowsthatitwasherroutinebehaviorandpeopledidnottakeit
seriously.Eventheeye-witnessNaveenKumar,thelabourerworking
thoughtthatshewastakingaselfieandafter2-3minuteshefoundher
hangingontheoutersideoftherailingandthereaftershelefttherailing.
Evenfromthedocumentsoftheprosecutionitisevidentthatboththe
parentsweremediatingtosortoutthetemperamentaldifferencesandthough
thepartieshadstartedlivingseparatelyfrom6thJune,2018ontheinsistence

24.CounteringtheargumentsoflearnedstandingCounselthatNeelam
BatrawroteamessagetoSushilaSinghviindicatinghowthepetitionerhad
fooledherandherhusbandtobelievethattheirdaughterwassufferingfrom
mentaldepression,itisstatedbylearnedcounselforthepetitionerthatafter
legaladvicewastakenandafterthepetitionerinformedMrs.NeelamBatra
thathehadsavedallthemessagesthatthecomplainantsentthemessageto
hismotherthatsheandherhusbandweremadetobelievethattheirdaughter
wassufferingfromdepression.

25.Nodoubtthereareanumberofconversationsbetweenthepetitioner
andthecomplainantwhereinthecomplainantadmittedherdaughter’s
medicalcondition,butwhetherthecomplainantandherhusbandwere
inducedtobelievethesamebythepetitionerorthatthemessageofthe
complainanttothepetitioner’smotherwasanafter-thoughtandtocoverup
herearliermessagesisanissuerequiredtobedeterminedduringthecourse
oftrial.Furthertowhatextenttherewasprovocationbythedeceasedorthat
thedeceasedcommittedsuicideduetooverdrinkingandnotbecauseofthe
conductofthepetitionerwillalsoberequiredtobedeterminedduringthe
courseoftrial.AtthisstagethisCourtisrequiredtoapplythe’primafacie’
testonly.

26.ApplyingthetestforgrantofbailaslaiddownbytheSupremeCourt,
itmaybenotedthatinthepresentcaseevenifthereisnoapprehensionthat
thepetitionerwouldfleefromjusticeandbenotavailablefortrial,the
accusationsofphysicalandmentalcrueltybeingseriousinnature,there

beingprimafaciematerialtoshowphysicalandmentalcruelty,andafew
publicwitnessesrequiredtobeexamined,thisCourtfindsnogroundto
grantbailtothepetitioneratthisstage.
