Item No.20 CRIMINAL REVISIONAL JURISDICTION
Ct.No.34
dc.
C.R.R. 4927 of 2023
In the matter of : Md. Ali @ Mohammad Ali … Petitioner.
Mr. Chittaranjan Ray … For the Petitioner.
Ms. Manisha Sharma … For the State.
Learned advocate appearing for the petitioner is
directed to serve copy of this revisional application upon Ms.
Manisha Sharma, learned advocate, who ordinarily appears
for the State. Her appointment may be regularised by the
concerned authorities.
The subject-matter of challenge in this revisional
application relates to Pandua Police Station Case No. 538 of
2023 dated 30.09.2023 which was registered for investigation
under Sections 498A/307/406 of the Indian Penal Code.
Learned advocate for the petitioner submits that the
petitioner is innocent of the charges and he has been falsely
implicated in connection with the instant case.
There are certain allegations against the private
opposite party. Be that as it may, the issues so canvassed
relate to question of facts which cannot be adjudicated at this
stage. Considering the stage at which the petitioner has
approached this Court and the investigation of the case is
under progress, I am of the view that the petitioner will be at
liberty to take up the issues with the investigating agency. No
interference is made by this Court at this stage.
2
The investigating authorities will take the investigation
to its logical conclusion in accordance with law.
With the aforesaid observations, the revisional
application being CRR 4927 of 2023 is disposed of.
Pending connected application, if any, is consequently
disposed of.
