In the matter of: Md Nur Alam Molla
… petitioner.

Mr M. Chatterjee
Mr G.N. Imrohi
… for the petitioner.

Mr Saswata Gopal Mukherjee
Ms Amita Gaur
… for the State.

The petitioner seeks bail in connection with Bamongola Police
Station Case No.24 of 2019 dated February 3, 2019 under Sections
498A/304/34 of the Indian Penal Code.

The petitioner is the husband of the victim who hanged herself
after 12 years of marriage.

The State produces the case diary and refers to the post-
mortem report which indicates the death to be consistent with
hanging and a case of suicide.

Considering that the petitioner may not have been involved in
the act which culminated in the unnatural death of his wife, the
custodial interrogation of the petitioner is not necessary.

or tamper with the evidence in any manner whatsoever and he shall
appear before the trial court on every date of hearing.

In the event of violation of any of the conditions, the trial court
will be at liberty to cancel the bail without reference to this court.

The prayer for bail is allowed, subject to the conditions stated
