ORAL ORDER

1. Prima facie, it appears that general and vague allegations
are alleged in the FIR being No.11208001200017 of 2020
registered with Mahila Police Station, Rajkot for the offence
punishable under sections 498A, 323, 504, 506(2) and 114 of
IPC and further prior to lodgement of FIR, first informant has
filed proceedings under section 125 of Code of Criminal
Procedure and also under the provisions of Domestic Violence
Act. Therefore, present petition deserves consideration.

2. Issue notice returnable on 31.08.2020. Learned APP
waives service of notice on behalf of the respondent – State.
Meanwhile, no coercive steps shall be taken against the
applicants. However, investigation to proceed in accordance
with law, but charge sheet shall not be filed without permission
of the Court. Learned APP waives service of notice on behalf of
the respondent – State.

3. Considering the nature of dispute and relationship
between the parties, the parties to the proceedings are
directed to explore possibility of settlement through the
Mediation Center annexed with the High Court. Concerned
learned Mediator shall submit his report to this Court on or
before the returnable date.
