Mina Chandulal Kotadia vs State Of Gujarat on 12 February, 2019

R/SCR.A/579/2019 ORDER

IN THE HIGH COURT OF GUJARAT AT AHMEDABAD

R/SPECIAL CRIMINAL APPLICATION NO. 579 of 2019

MINA CHANDULAL KOTADIA
Versus
STATE OF GUJARAT

Appearance:
NANAVATI ASSOCIATES(1375) for the PETITIONER(s) No. 1
for the RESPONDENT(s) No. 2
MS MAITHILI MEHTA, APP (2) for the RESPONDENT(s) No. 1

CORAM: HONOURABLE MS JUSTICE SONIA GOKANI

Date : 12/02/2019
ORAL ORDER

1. Seeking quashment of FIR being C.R.No. I-9/2018 registered
at Mahila Police Station, Ahmedabad Rural, Ahmedabad filed
for the offences punishable under sections 498A and 114 of
IPC and also for the offences punishable under sections 3 and
7 of the Dowry Prohibition Act, this petition has been
preferred.

2. It is urged that the petitioner is a citizen of USA and resides in
USA from the past twenty years. She sporadically visits India
since her family is here. According to her, the complaint is
nothing but an attempt to maliciously drag her into the
matrimonial issues where in fact, she has no role to play from
USA. This Court has heard learned senior advocate
Mr. Nanavati who has urged that the version set out in the FIR
is baseless and the same indicated that the sister-in-law has

been dragged there only with a view to get her passport seized
by the police.

3. Issue Notice returnable on 27.02.2019. Learned APP waives
service of notice on behalf of the respondent-State. There
should be no coercive action against the petitioner. Let the
police not insist on seizure of her passport. Let the possibility
of amicable settlement be explored. For that purpose, High
Court Mediation Center make an effort for the same. For
convenience, contact numbers of the petitioner and respondent
are produced below:

Petitioner-Mina Kotadia- 0114082602938
Respondent No.2-Vishakhaben Thumar- 8780020162

4. Let the Mediator submit a report on or before the returnable
date. Direct service is permitted.
