This is an application for quashing of a proceeding where
charge sheet was submitted under Sections 498A/406 of the
Indian Penal Code.
The learned Advocate appearing on behalf of the petitioners
submits that a compromise has been effected by and between the
parties being the accused petitioners and the opposite party
no.2/de-facto complainant and an application for joint
compromise has also been filed which may be listed.
The learned Advocate appearing on behalf of the opposite
party no.2/de-facto complainant supports the contention of the
learned Advocate for the petitioners as regards the question of
quashing of the proceedings on a compromise.
The petitioners are directed to serve a copy of this
application upon the State through the learned Public Prosecutor
within a week and an affidavit of service to that effect shall be
filed on the next date of hearing.
Let this matter along with compromise application come up
as a “Contested Application” four weeks hence.
The impugned proceedings pending in GR Case No.1231 of
2017 before the learned Additional Chief Judicial Magistrate,
Baruipur, South 24 Parganas is stayed for a period of eight weeks
from this date.

The parties are at liberty to pray for extension and/or
modification and/or cancellation of the interim order upon notice
to the other side.
Urgent photostat certified copy of this order, if applied for,
shall be given to the parties as expeditiously as possible on
compliance of all necessary formalities.
