AND CONSEQUENTLY ALLOW IA NO.13 AND 14 FILED IN G AND WC
NO.67/2015 ANNEXURE-A.

THIS WRIT PETITION COMING ON FOR ORDERS THIS DAY, THE
COURT MADE THE FOLLOWING:

ORDER

Heard Smt. Shalini John, learned advocate for the

petitioner and Shri B.S.Ganesh Prasad, learned advocate

for the respondent. By consent of learned advocates on

both sides, this matter is taken up for final disposal.

2. The matter before the Trial Court arises out of the

Guardians and Wards Act, 1890. Petitioner-husband has

challenged common orders dated 21.12.2019 on

I.As.No.13 14 in case No.GWC/67/2015 passed by III

Additional Principal Judge, Family Court, Bengaluru,

rejecting his prayer to further cross-examination of

respondent-wife. This petition is filed with a prayer to

quash the impugned order and to allow the applications.

3. Shri B.S.Ganesh Prasad, learned advocate appearing

for the respondent submits that he has no objection for

allowing this petition subject to payment of cost by

petitioner.

4. Learned advocate for the petitioner submits that

Trial Court has already imposed cost of Rs.2,000/-.

5. In view of submissions made by learned advocates

for the parties, this petition is disposed of granting one

opportunity to the petitioner for cross-examining the

respondent before the Trial Court.

6. Learned Trial Judge shall permit the petitioner to

cross-examine PW.1-respondent/wife on 29.01.2020 on

payment of cost of Rs.8,000/- to her.
