O R D E R

Petitioner is the sole accused in Crime

No.1175/2018 of Payyannur Police Station, Kannur

District for offences punishable under Sections

306 and 498A of IPC. The allegation of the

prosecution is that the petitioner subjected his

wife to cruelty both physically and mentally and

thereby drove her to commit suicide. Crime was

registered and the petitioner was arrested on

22.10.2018. He is in custody since then. He

seeks bail.

2. It seems that the investigation has

substantially progressed. The crucial witnesses

have been questioned and their statements

recorded. Having considered these facts, I am

inclined to grant bail to the petitioner.

Hence, the bail application is allowed on the

following conditions:

(i) Petitioner shall execute a bond for a sum

of ₹50,000/- (Rupees fifty thousand only) with two

sureties for the like sum each to the satisfaction

of the jurisdictional Court.

(ii) He shall surrender his passport, if not

already surrendered, within 7 days from the date

of execution of the bond and if not, file an

affidavit in this regard before the jurisdictional

court. However, further directions regarding the

release of the passport will be within the

jurisdiction of the concerned jurisdictional

court.

(iii) He shall appear before the Investigating

Officer as and when called for.

(iv) He shall not threaten, coerce or

intimidate the defacto complainant and the

witnesses nor shall he interfere in the process of

investigation.
