Issue notice on merit as well as MP no.01/2017 to the respondent.

List on 01.03.2018.

Learned counsel for the petitioner submits that even though petition seeking
maintenance by the respondent under Section 488 of the CrPC was dismissed, yet
the Trial Court vide impugned order has directed the petitioner to pay a sum of
Rs.1200/- per month as maintenance pendente lite and the petitioner has also been
directed to pay a sum of Rs.3,500/- as litigation expenses. Learned counsel for the
petitioner submits that he is ready and willing to pay the litigation expenses. It is
also submitted that proceeding for execution are fixed today before the executing
Court and in case, the petitioner does not pay the amount, bailable warrant shall
be issued against the petitioner.

In view of the aforesaid submissions and in the facts of the case, it is
directed that in case petitioner deposits the amount of litigation expenses within a
period of three weeks from today, the execution of the warrant issued against the
petitioner shall remain stayed till next date of hearing.
